蒼井そらさんが「売国奴」にされたことの真相

前回エントリで触れたおかしな報道の件、中国でも検証されていた。

劉彦偉さんは、中国版ツイッター『微博』で37万人以上のフォロワーをかかえる人気ライターだが、その劉さんが今回の一連の空騒ぎの一部始終について検証をしていた。

オレには中国語の繊細なニュアンスが分からないので、大ざっぱに要約するだけだが、その内容は以下のようなものだ。より正確な文面を知りたいひとは、劉彦偉さんの投稿本文をご覧ください。

今年2013年の8月8日、中国の軍事サイト『鉄血網』に、1人の一般ユーザーが書き込みをした。それが「五大売国的日本人」とされるものの正体で、蒼井そら、矢野浩二、井上清、宮崎駿、鳩山由紀夫が挙げられている。この書き込みは、たんに中国人が書いたというだけでなく、中国人の視点から書かれているのがポイントで、とくに矢野浩二にいたっては、日本人にはまったく知られていない人物だ。

この書き込みが、『新華網軍事』などのウェブサイトに転載されていくことになる。

3日後の11日、海外の中国語メディア『多維新聞網』の軍事カテゴリに、「五人の売国的日本人」が掲載された。これは明らかに前述の書き込みを元にしたものだが、同時に加筆も行われている。蒼井そらが釣魚島をめぐり中国の立場を支持した、というもので、蒼井が「釣魚島は中国のもの」と書いたとする写真を掲載している。

しかし実際は、この写真は中国のネットユーザーが加工したものであり、本来は「李娜さん、がんばれ」と書かれていたものである。蒼井が釣魚島問題で中国を支持したことはないし、とうぜん日本の右翼がボイコットすることなどありえないのである。

また矢野浩二は、中国ではたいへん有名であるが、日本ではまったくもって知られていない。日本の右翼がかれを攻撃することなど、ありえないのだ。

『多維新聞網』の記事が転載されるうちに、1人の日本人ブロガー宮崎正弘の目にとまることになった。宮崎は10月23日のブログ記事で『多維新聞網』軍事カテゴリの報道に拠るものとして、「中国で『英雄』視されている五人の日本人がいる」とし、その五人を列挙したうえで、「『この五人は日本の右翼に“売国奴”と非難されている』と報道した」としている。

それが宮崎正弘のブログ記事であることが知られないまま、最後には大げさに取り上げられるようになり、(『騰訊娯楽』に記事が掲載された)12月13日が到来したのである。

12月13日とは、なんの日だったか。これは南京事件のあった日なのである。この日の午前11時54分、矢野浩二が(中国版ツイッター)『微博』にこのように書いた。「今日は12月13日。われわれは亡くなった人々を追悼し、そして歴史に真正面から向きあわなければいけません。平和と友好こそが、ともに進歩していくための基本です」と。

午後3時34分、このサイト(『騰訊網』)の娯楽カテゴリに「矢野浩二が、ふたたび日本の右翼メディアによって五大売国奴に数え上げられる」とする記事が掲載された。この記事が多数のメディアに転載されていく元となった。この記事では、矢野浩二の午前のツイートが引用されている。

蒼井そらさんが実際に書いたのは「李娜さん、がんばれ」というものだった。李娜さんは、中国の女子テニスプレイヤー。この応援メッセージについては、さまざまなメディアで報じられたので、Googleで検索すればいくつものバリエーションで見ることができる。

【要出典】「日本右翼が五大売国奴を批判」と中国報道?レコードチャイナのいい加減さ

レコードチャイナが「『日本右翼が五大売国奴を批判』と中国報道、中国ネットユーザーの反応とは―中国メディア」と題して、以下のように伝えている。

2013年12月14日、金鷹網は記事「日本右翼メディア、蒼井そら、矢野浩二など五大売国奴を批判」を掲載した。 

ある「日本の総合軍事メディア」の報道によると、中国人に愛されている日本の著名人5人が日本では売国奴扱いされているという。その5人とは中国で活躍する俳優の矢野浩二さん、鳩山由紀夫元首相、宮崎駿監督、タレントの蒼井そらさん、小説家の井上清さんだという。 

この「五大売国奴」の記事は今年8月に米華字紙・多維網が報じたおもの。ただしその記事では「日本の総合軍事メディア」が報じたという文言はなく、多維網の記事が転載される過程で付け加えられた情報とみられる。 

なんともいいかげんな記事だが、1400件ものコメントがついている。日本を批判するコメントもあるが、「日本にはたった5人しか売国奴がいないの?中国の売国奴がそんなに少なかったら、ずっと昔に日本を滅ぼせていたよ」「日本の友人に敬意を評して、蒼井そら先生の海賊版AVをダウンロードします」「鳩山由紀夫って首相だっけ?」「いや元首相でしょ」「蒼井先生愛している」などのコメントも残されていた。(翻訳・編集/KT)

レコードチャイナ記事のいい加減さ

「なんともいいかげんな記事」と断ずるこの記事こそ、いい加減な記事そのものだ。

レコードチャイナは、これを「金鷹網は…を掲載した」とするが、実際に金鷹網の記事を見ると、「騰訊娯楽が伝えるところによると」とある。この騰訊娯楽は、その名の通り、エンタメ情報を伝えるものだ。海外のエンタメ情報紙の報道を、政治的な文脈に持ちこむレコードチャイナ紙は、どうかしているのではないか。

レコードチャイナは、「この『五大売国奴』の記事は今年8月に米華字紙・多維網が報じたおもの(ママ)。ただしのその記事では『日本の総合軍事メディア』が報じたという文言はなく、多維網の記事が転載される過程で付け加えられた情報とみられる」と、しょうもない妄想を発揮している。

きちんと騰訊娯楽の記事を見れば、「日本の総合軍事メディアが、中国人に愛されている五人は、日本にとっては売国奴である、と報じている」とあり、一次報道の時点ですでにこの文言が入っていたことが分かる。ここでいう日本の総合軍事メディアとは、『宮崎正弘の国際ニュース・早読み』の4049号を指している。Googleで検索すればすぐに見つかるものだ。

この『宮崎正弘の国際ニュース・早読み』は、総合軍事メディアと呼ぶにはまったく似つかわしくないが、騰訊娯楽の指摘する事実は存在しているわけであり、レコードチャイナはみずからの取材不足によるデタラメを、中国メディアのせいにしているのである。

そして、この『早読み』4049号を見ると、「多維新聞網(2013年8月11日付け)によれば、これら五人は『日本の右翼が“売国奴”と非難している』と解説が附せられている」とあり、ここで多維新聞網の解説とされているものは、以下のページである(1つの記事が複数ページに分割されている)。

『早読み』では、「中国で『英雄』視されている五人の日本人がいる」としているが、多維新聞網が書いているのは、「日中関係が悪化すると、民間人が交流しただけで自国民から『売国』『裏切り』と非難される」というものであり、続けて「日本の極右勢力にとっては、この五人が裏切り者に見えるようだ」としている。どこにも「英雄」などという文言はない。宮崎正弘氏はどこからこの文言を持ってきたのだろうか。

なお、井上清氏について、多維新聞網は「学者」、騰訊娯楽と金鷹網は「左翼歴史学者」としている。レコードチャイナは、どこから「小説家」という文言を持ってきたのだろうか。

日本の主要政党の入党要件

Twitterでつぶやいたら、意外にけっこうな反響があったので、まとめてみた。

以上はウェブ上の情報を元にしたもので、調査がおよばず分からなかったことや、実際とは異なる場合がある。

公明党の党費について、Wikipediaでは3000円とするが、規約には「党費に関する細則は、別に定める」とあり、この別途に定めた細則についてはサイト上に見あたらなかった。大阪市議の辻よしたか氏のご教示により年額3000円、家族2人目以降は2000円と判明した。機関紙の購読料、党友の会費については分からなかった。党員の国籍を問わないことは、「国籍を問わず党員となることができる」と規約に明記されている。

社民党の入党資格については、サイト上に見あたらなかったが、大阪府連のサイトに党則が掲載されている。ただし、「入党手続その他党員の資格に関し必要な事項は、本党則に定めるもののほか、別に定める規則による」とあり、日本国籍を要件としているかどうかは分からなかった。党費に幅があるのは、年齢層別に党費を設定しているからである。

社民党は「18歳以上で、日本に3年以上定住する外国人」にも入党の資格を与えているそうな。

生活の党は、サイト上に入党案内がなく、党の規約にも「但し、党費については別の規程で定める」とあるのみで、具体的な金額は掲載されていなかった。

記載漏れや間違いのご指摘は、大歓迎です。

Windows(XAMPP)上の Apache が Perlで制作した CGI で吐くエラーの解決方法

Windows 7 環境に XAMPP をインストールし、別途 Strawberry Perl をインストールしている。稼働中のシステムを、サイトから丸ごとダウンロードし、上記ローカルの開発環境で動かしたいが、Perl で書かれた CGI スクリプトが 500 エラーを吐いてしまう。

エラーは、次のようなものだった(ちなみに、エラーコードは 720003 や 720005 などになることがある模様。720002 はファイルが見つからない、720003 はディレクトリが見つからない、720005 はアクセス権限がない、という意味。オレの環境でも 720005 は見たことがある)。

    サーバ内部で障害が発生し、 リクエストに応えることができませんでした。

CGI スクリプトの先頭行に #! で始まる Shebang が記述され、これが邪魔になっている。Shebang の記述する場所に perl.exe が存在しないためだ。CGI ファイルは多数あり、その全ての Shebang を変えるのは手間がかかるし、あとでリモート環境にアップロードしたとき、トラブルを起こす恐れがある。

これを解決する簡単な方法がないか、探ってみた。

  1. Shebang の記述通りの場所に Strawberry Perl をインストールする
  2. Windows のジャンクション機能を使う
  3. Apache の設定で Shebang を無視させる

Shebang の記述通りの場所に Strawberry Perl をインストールする

ネットで検索してみたところ、この方法で回避しているひとが多いようだった。つまり、Strawberry Perl をいったんアンインストールして、C:\usr\ にインストールし直す、というわけである。単純に移動するだけでいいかもしれないが、レジストリなどに影響があるかもしれないので、いったんアンインストールした方がいいだろう。

この方法は、すこし影響が大きすぎるように感じる。

Windows のジャンクション機能を使う

Windows のファイルシステムには、ジャンクションという機能があり、これを使えば、Shebang の /usr/bin/perl を C:\strawberry\per\bin\perl.exe とシステムに読み替えさせることができる。perl.exe に対してではなく、これを含むディレクトリに対して設定した方がいいだろう。コマンドプロンプトを開き、次のコマンドを実行すればよい。

C:\>mkdir C:\usr
C:\>mklink /J "/usr/bin/" "C:\strawberry\perl\bin\"

ただ、この方法では、簡単なスクリプトなら動かせるものの、オレの環境ではあまり大きなシステムを動かすことができなかった。それは、CPAN を通じてインストールした DBI.pm などの各種モジュールのパスが通らないためで、環境変数 PATH にモジュールのパスを追記すれば動きそうだが、オレはあまり環境変数を汚したくなかったので、この方法を試すのを途中でやめた。

C:\strawberry\perl\bin\ だけならまだしも、複数の場所に分散している全ての lib ディレクトリを環境変数に追記したり、それぞれにジャンクションを張ったりするのは難しく、うまくいったとしても、かなりの大仕事になりそうだ。

Apache の設定で Shebang を無視させる

この方法がいちばん簡単だし、他への汚染や影響がいちばん少ないと思う。

Apache の設定ファイル httpd.conf に ScriptInterpreterSource ディレクティブを追記し、Apache を再起動する。記述する場所はどこでもよいが、<VirtualHost> や <Directory> ディレクティブを使用しているなら、その中に記述するのがいいだろう。オレの環境では、次のように設定した。

このディレクティブでは、スクリプトを Windows システムで関連付けられた実行ファイルで開く、という設定をしている。従って、以下のように、レジストリに関連付けを行う必要がある。

@="C:\\strawberry\\perl\\bin\\perl.exe"

上記を、execcgi.reg などというファイル名で保存し、実行する。これで拡張子が .cgi のもの、たとえば http://localhost:55555/test.cgi などが呼ばれたとき、Apache はこのレジストリを参照して、Strawberry Perl で CGI スクリプトを実行してくれる。必要があれば、上記 .cgi を .pl に変えてふたたび実行すれば、test.pl なども動かすことができる。

それでもエラーが出るとき

上記の設定をしたあとでも、以下のエラーが発生した。

Server error!

    サーバ内部で障害が発生し、 リクエストに応えることができませんでした。

    サーバーの障害と思われる場合は、ウェブ管理者までご連絡ください。

ほとんどの場合、たんに必要とするモジュールがインストールされていないだけなので(エラーログを見ると、やはり予想通りだった)、CPAN コマンドでインストールする。

オレの環境では、これで万事うまくいった。モジュールがインストールされてるのに、同じエラーが出る場合は、@INC にそのモジュールまでのパスが通ってないので、なんとかする。

ふだん Perl は使わないので、なにか誤解しているところがあるかもしれない。間違いがあったら、遠慮なくご指摘ください。

ユニセフ「承認協定」及び「協力協定」の電子テキスト

ユニセフ「承認協定」及び「協力協定」は、国連機関であるユニセフ本部と、世界36ヶ所に存在する各国の民間団体である国内委員会との間で、相互に交わされた協定書です。

ウェブ上に電子テキスト化されたものが見あたらなかったので、閲覧と検索の便宜のため、テキストに起こしてみました。ただし、「附則資料」のテキスト化は省略しています。底本は(国内委員会の一つ)日本ユニセフ協会が交わした協定書のスキャン画像を収めた PDF ファイルです。これを Google Drive の OCR 機能を用いてテキストに変換し、手作業にて修正を加えています。テキストの内容は、底本 PDF と食い違う場合があります。

なお、このページは、ユニセフ本部、または日本ユニセフ協会の要請により、予告なく削除される可能性があります。(丸1日がかりで入力してるので、削除要請されたらたぶん泣きます。)

Cooperation Agreement

An agreement fostering and strengthening the relationship between the National Committee and UNICEF and providing the framework for alignment of operations to bring the best passive benefits for children.


Introduction

This Cooperation Agreement exists to recognize, support, strengthen and define the partnership between UNICEF and each and every one of its National Committees. This partnership is built on out shared commitment to the unique mandate accorded to UNICEF by the United Nations to uphold all rights of all children everywhere in accordance with the principles, values and commitments of the United Nations Convention on the Rights of the Child.

The Cooperation Agreement recognizes and values the real and potential contribution of National Committees, working within a powerful partnership that is unique within the UN family, to enhance and empower UNICEF’s mission to build a world fit for children.

Working together, we can build the global public and political support that can bring this world closer; we can strengthen UNICEF and its work, and the rights of all children; make UNICEF known and respected in every community; and we can mobilize and leverage the resources needed to ensure that children survive and thrive, are lifted out of poverty, are healthy, educated, protected and treated fairly, and have a voice in the decisions that affect them.

Our greatest asset in this unique mission is the name and brand of UNICEF and the credibility, respect and understanding this brand brings to our work for children. Through this Agreement, we commit to our duty for the responsible stewardship of the UNICEF Brand. Through our work together, we will ensure that the power of UNICEF’s name is applied in the best interests of children in ways that protect and enhance the reputation, regard, influence and authority of our brand. National Committees appreciate and value the trust that is placed in them, as independent entities, to employ as well as safegurad the name and logo of UNICEF in their daily work for children and they pledge their full commitment to advance the mission and mandate of UNICEF with responsibility, courage, creativity and cooperation in each of the societies, in which National Committees operate.

This Agreement establishes the framework and parameters for cooperation between UNICEF and its National Committees. Its goal is to maximize the potential of our partnership for children. To do so, it seeks to empower, facilitate and enable the work of National Committees to be the very best they can be, to embody the spirit of UNICEF, to exemplify the best and highest achievable standards in the governance and conduct of their affairs, and to achieve exceptional and continuously improving results for children through fundraising, advocacy, communications and other activities as defined by the Agreement.

Through this Agreement, and with the support of UNICEF, the National Committees will work to create awareness and understanding amongst the peoples of National Committee countries for the rights and well-being of all children, and to embody, foster and channel the engagement and commitment to UNICEF and its mission and mandate within their societies in ways appropriate to the particular legal, political, cultural and commercial characteristics of these societies.

We are driven by our shared passion to ensure that no child is denied his or her rights and that all children are able to fulfil their potential and contribute to the greatest extent to a better, safer, more just and sustainable world in the present, and for the future which they will inherit. We believe that this world can and must be achieved. Every part of our Agreement and every effort we make together shall be directed to this end. We agree to strive together in mutual trust, respect and collaboration towards this goal.

Preamble

Whereas UNICEF is an international organization with a strong globally recognized brand mandated by the United Nations General Assembly to advocate for the promotion and protection of children's rights, to help meet their basic needs and to expand their opportunities to reach their full potential everywhere and is the leading advocate for children’s rights, active worldwide including through National Committees,

Whereas the National Committee is a non-governmental organization created in its territory for the purposes of advancing children’s rights and well-being globally through resource mobilization, advocacy and other activities in its territory advancing UNICEF’s unique mission in accordance with this Agreement,

Whereas UNICEF and the National Committee are partners in the UNICEF family uniting for universal rights and results for children everywhere,

The Parties,

Affirm their commitment to advancing children’s rights and strive to help achieve the objectives set out in the United Nations Convention on the Rights of the Child, the United Nations Convention on the Elimination of All Forms of Discrimination against Women, the United Nations Millennium Development Goals, UNICEF’S Mission Statement and Strategic Plan (the "UNICEF Objectives").

Agree that the objective of this Agreement is to provide the fundamental governing framework for the relationship between UNICEF and the National Committee and further agree that the underpinning foundations of this Agreement are based on mutual respect, trust and cooperation.

Recognize that National Committees use the UNICEF Brand in their territories with the approval of UNICEF.

Note that both Parties are committed to ensuring transparency in their operations and the fullest possible information sharing, cooperation and support for each other towards the achievement of their common goals.

Recognize that the Parties are independent entities with distinct but complementary roles.

Also recognize the value and contributions that can be made by the National Committee to the UNICEF Objectives taking into consideration its strengths, or potential strengths, with respect to local knowledge, credibility and acceptance in the community to promote the rights of children.

Further recognize that UNICEF works in a range of diverse environments with differing and changing challenges to the promotion and protection of child rights.

Further recognize that the National Committee operates in a competitive ever-changing territory-specific environment where sound business management by the National Committee is imperative for the success of UNICEF’s work in industrialized countries and globally.

Adhere to the highest possible standards of integrity and professionalism in the conduct of their relationship and their operations in order to ensure the success of this Agreement.

Note that UNICEF is committed to provide full support to the National Committee in the achievement of their goals and aspirations in accordance with this Agreement.

Acknowledge that this Agreement builds on the success of UNICEF’s unique National Committees’ structure, with a long tradition of strength and solidarity between the National Committees, and enables and facilitates the National Committees’ role as fundraisers for UNICEF’s programmes and advocates for the rights of children.


  1. Terms and definitions

    Capitalized Terms and Definitions used in this Agreement shall have the meaning set forth in Annex A hereto, which shall be considered as part hereof.

  2. Roles of the National Committee

    1. To further the shared goals of the Parties, the primary role of the National Committee in accordance with this Agreement is to contribute to the advancement of children’s rights globally. The National Committee will pursue this goal through the following means:

      1. primarily, by raising funds in the territory from the general public, the private sector and other sources, as provided for in Section 11 below.
      2. secondly, by advocating for children and promoting children’s rights internationally and domestically through activities in the territory as provided for in Section 12 below; as well as
      3. by supporting UNICEF’s relations with governments including facilitating and encouraging government contributions to UNICEF; and
      4. by being a valuable knowledge source for UNICEF with respect to the territory.
    2. The Parties recognize that the above roles are interrelated and mutually supportive and that the National Committee will undertake these roles only for the advancement of children’s rights consistent with the objectives of the National Committee and National Law.

  3. Rules of UNICEF

    1. To further the shared goals of the Parties, the roles of UNICEF in accordance with this Agreement are:

      1. To provide overall global leadership, strategies and standards as part of an overall framework for action by the National Committee community and UNICEF;
      2. To develop quality programmes for children from the funds raised and given to UNICEF pursuant to this Agreement;
      3. To grant the National Committee the right to use the UNICEF Brand in the territory;
      4. To provide guidance, support and coordination for fulfilment of the National Committee roles in the context of overall UNICEF Policy;
      5. To support the National Committee to ensure that fundraising and child rights advocacy in furtherance of UNICEF Policy are being undertaken in the territory;
      6. To report on programmes and their results for children to the National Committee in line with best practice and Annex B; and
      7. To ensure well-defined processes, and ongoing active adherence to those processes to monitor the implementation of this Agreement and to ensure ongoing evaluation of the relationship to assist both Parties in delivering on their objectives and ensuring results for children.
  4. UNICEF Policy

    1. The National Committee is established to promote the rights and well-being of children and, in pursuing this objective through the use of UNICEF’s name and brand, is committed to supporting and upholding UNICEF Policy.
    2. UNICEF will provide information and support to the National Committee to improve awareness of UNICEF Policy and assist with interpretation and implementation.
    3. Where UNICEF Policy is lacking or unclear, the National Committee will request, and UNICEF will provide, guidance, within an agreed time frame.
  5. UNICEF Brand and intellectual property

    1. UNICEF grants the National Committee the right to use the UNICEF name, logo, brand and any other associated intellectual property (collectively the "UNICEF Brand"). In this context, UNICEF will ensure that the National Committee is informed of UNICEF Policy. UNICEF will consult with the Standing Group with respect to the development of, and amendments to, National Committee-relevant UNICEF Brand use guidelines that will be followed by the National Committee.
    2. The National Committee agrees that it will not amend or change the UNICEF Signature (name or logo) when using the UNICEF Signature.
    3. The National Committee agrees to refrain from being a party, directly or indirectly, to any agreement, or otherwise allow the use of the UNICEF Brand in a way that might prejudice the UNICEF Brand and/0r the reputation and credibility of UNICEF.
    4. The National Committee will not grant a third party rights with respect to UNICEF’s Brand unless authorized to do so in accordance with UNICEF Brand use guidelines. If the guidelines do not authorize such a grant, prior agreement in writing from UNICEF must be obtained.
    5. The National Committee has an obligation to monitor third party use or misuse of the UNICEF Brand in the territory and report immediately to UNICEF any misuse with potential to damage the UNICEF Brand. The National Committee will use every endeavour to take swift remedial action, and will consult and agree on action with UNICEF if significant action, such as legal proceedings, is required.
  6. National Committee name, structure, recognition and external relationships

    1. The National Committee is an independent legal entity, associated with UNICEF but neither owned nor controlled by UNICEF, but where the relationship is managed by both Parties in accordance with this agreement (including through the provisions relating to the agreement on a Joint Strategic Plan).
    2. The National Committee will use as its formal legal name, 公益財団法人日本ユニセフ協会 (Japan Committee for UNICEF), in all legal documents and commitments.
    3. However, in its daily operations it is recognized that the National Committee may need a shorter name, in which case it may use the name UNICEF Japan or alternatively will use a name as agreed with UNICEF in writing in order to clearly differentiate its communications and activities from those of UNICEF. When using the UNICEF Signature the National Committee shall ensure that it includes a distinctive reference to the National Committee’s separate status. The National Committee will not seek to portray itself as "UNICEF", the United Nations entity, in any aspect of its activities.
    4. UNICEF will provide support and assistance to the National Committee as appropriate to help it ensure that it adopts and maintains the most advantageous legal structure, particularly with respect to maximizing fiscal advantages.
    5. The National Committee will consult with UNICEF during the development and review of new or existing Statutes and legal structures prior to implementing changes (other than technical changes) and make all reasonable effort to achieve agreement, ensuring that Statutes are always consistent with the Principles of Good Governance (Annex C). Any change of legal name for the National Committee must be agreed with UNICEF if the word "UNICEF" appears in the name. Copies of the final official approved Statutes for the National Committee and any Related Entities must be submitted to UNICEF within one month of official registration of the Statutes or their amendment, together with a professional English translation.
    6. UNICEF recognizes the National Committee as its exclusive partner to promote the mandate of UNICEF in the territory in accordance with this Agreement. UNICEF will sign a unilateral Recognition Declaration at the time of execution of this Agreement that the National Committee may use to assert its rights and authority as necessary with third parties. This does not prevent UNICEF granting rights to the UNICEF Brand to third parties operating in the territory if in accordance with other parts of this Agreement or with the agreement of the National Committee.
    7. The National Committee shall make all reasonable efforts to ensure that its general members (if relevant), governing body members, employed staff and volunteers are not involved with activities that are likely to bring UNICEF into disrepute.
    8. The Parties shall make all reasonable efforts to ensure that they do not do business with, or otherwise partner with, organizations whose activities are likely to bring UNICEF or a National Committee into disrepute. In this context, the National Committee and UNICEF will also seek to ensure that suppliers and business partners adhere to appropriate ethical standards.
  7. National Committee Related Entities (foundations and other entities)

    1. The National Committee must obtain the agreement of UNICEF before establishing, owning a majority share in, controlling or diverting funds to a new separately owned or controlled legal entity (a. "Related Entity"), including, but not limited to, a foundation or endowment fund or a trading company, and consult with UNICEF regarding the optimum structure. Reasons for establishing a Related Entity are fiscal or financial benefits, donor requirements or a UNICEF-agreed reason. The strategy for management and monitoring of a new or existing Related Entity will be included in the Joint Strategic Plan (JSP). UNICEF will not unreasonably withhold or delay agreement and will provide or refuse consent to a request for a Related Entity within three months of a written request from the National Committee or such shorter period as the circumstances reasonably require.
    2. The National Committee will ensure that a Related Entity complies with this Agreement and the JSP, in particular (but not limited to) ensuring that the Related Entity complies with all financial and other UNICEF reporting requirements.
    3. The National Committee will give UNICEF a copy of the Statutes for any existing Related Entities, and amend a current JSP if necessary to incorporate the Related Entity, within four months of signing this Agreement.
  8. UNICEF and National Committee relations and general reporting obligations

    The Parties recognize the importance of clear information channels and reporting. UNICEF and the National Committee will work together in a spirit of mutual respect, partnership and transparency, sharing information and ideas, consulting and assisting each other, for the effective achievement of their shared Objectives. Annex B includes reporting requirements and information exchange principles.

  9. Governance

    1. The Parties agree to the Principles of Good Governance attached as Annex C. The National Committee will review its alignment with these principles and ensure compliance or explain variations or exceptions. The National Committee will notify UNICEF and provide explanation of all variations and exceptions and UNICEF will provide support to comply whenever possible.
    2. In particular, the National Committee will ensure adherence to appropriate standards for the conduct of the of not-for-profit organizations and strive to attain the highest possible standards of best practice applicable in the territory.
    3. The National Committee agrees to consult UNICEF on the process for the selection of the Executive Director of the National Committee. This process will include the opportunity for UNICEF to be invited to participate in the selection process and thereby to provide opinion on short-listed candidates. The final decision on the appointment of the Executive Director remains the responsibility of the National Committee.
    4. UNICEF agrees to consult with the Standing Group on the process for the selection of the Director of Private Fundraising and Partnerships (PFP). This process will include the opportunity for a representative of the Standing Group to provide opinion on short-listed candidates. The final decision on appointment of the Director of PFP remains the responsibility of UNICEF.
    5. The Parties agree to each undertake regular risk management exercises and establish crisis prevention and crisis management processes; in the ease of the National Committee, this will be done in accordance with the Governance Principles. UNICEF will provide support to the National Committee as appropriate.
  10. Joint Strategic Plan

    1. An agreed Joint Strategic Plan (JSP) is essential and shall be mandatory, to ensure that the operations and activities of the National Committee are planned in an appropriately collaborative way with UNICEF and that the elements of support from UNICEF are agreed, which will, in turn, provide the framework for delivering the best results for children. The objective of the JSP process will be to ensure that the work of the Parties is directed toward the achievement of the Parties’ objectives and is cost-effective. The procedure for the development and monitoring of a JSP is detailed in Annex E.
    2. The Parties will adept a JSP, or reaffirm an existing JSP, every three years unless another period is mutually agreed. An existing JSP will remain in force until a new JSP is agreed and enters into operation.
    3. A JSP that is already agreed between the Parties before this Agreement shall remain in force for its previously agreed duration. If there is no valid JSP at the time of entering into this Agreement, the Parties shall make best efforts to agree on anew JSP within six months, and the Parties will adopt a JSP within 12 months.
    4. Performance of both Parties as measured against the JSP will be reviewed annually in accordance with the procedures set out in Annex E. If, in the context of periodic reviews, targets or commitments are not being met, or appear unlikely to be met, the Parties will work together to develop roadmaps to ensure necessary adjustments for optimal performance.
  11. Fundraising

    1. Fundraising includes all income, other than from National Governments, (unless as indicated in Section 11, paragraph (h) below), generated in the territory and/or by the National Committee on behalf of or for UNICEF for the ultimate benefit of children, for example, direct solicitations, promotional events, sponsorships, working with corporate partners and foundations, funding from local or regional government, and the sale of UNICEF Cards and Products.
    2. The National Committee will ensure that fundraising campaigns and material meet relevant ethical standards and are in accordance with Section 5 above.
    3. Donations from civil society and the private sector

    4. UNICEF will communicate to the National Committee its overall funding needs based on UNICEF’s strategic plans. Specific targets, and mechanisms for achieving these, will be agreed in the JSP.
    5. The National Committee will develop strategies as part of the JSP, with support from UNICEF, to strive to maximize funds for children and in that context will seek to raise funds in the order of preference for Regular Resources, Thematic Other Resources and Non-Thematic Other Resources. In particular, the National Committee will strive to ensure that unnecessary restrictions on funds raised are avoided. UNICEF will only accept resources in line with agreed programmatic priorities and activities.
    6. Conversions of Regular Resources to Other Resources projects should only be made in accordance with National Committee Board approved policy. The National Committee will ensure that a Board policy is implemented and maintained; the policy will include provisions for consulting UNICEF when conversions to Other Resources of greater than US$50,000 are planned.
    7. UNICEF shall develop an overall priority mechanism for Other Resources funding that includes a database accessible to the National Committee. The National Committee will, when donations are solicited or received, have regard to UNICEF’s programme funding priorities as defined through this mechanism. When a proposed donation does not fall within the priority mechanism parameters the National Committee will make best efforts to determine if there can be alignment of donor wishes and UNICEF priorities. Funding that does not suit programme needs will not be accepted by UNICEF.
    8. Funds from a government or an intergovernmental source

    9. Sometimes National Law procedures enable the National Committee to access national or supra-national government funding for international development and emergencies that is not otherwise available to UNICEF (often called the "NGO window"), The National Committee is encouraged to seek any such funds in support of WICEF programmes.
    10. National, regional and local government grants may also be received by the National Committee to fund National Committee activities. The National Committee will report to UNICEF on such funds.
    11. If funding for the direct benefit of UNICEF is received, exceptionally, from a national government or an intergovernmental organization for international programmes other than through the NGO window, the National Committee will transmit the funds in full to UNICEF.
    12. Sub-national government funds may also be available for international purposes and access to such funds will fall within the normal fundraising provisions of this agreement, unless otherwise agreed with UNICEF, with retention of costs as necessary.
    13. In Kind Assistance

    14. Targets and mechanisms for In Kind Assistance will be set out in the JSP.
    15. UNICEF Cards and Products

    16. The scope of product sales activity and the specific requirements are agreed as follows:

      1. The National Committee acts as UNICEF’s main sales and distribution agent within the territory for the marketing, distribution and sale of UNICEF-owned Cards and Products. UNICEF has a global leadership role in, and responsibility for, finding new and innovative promotion, sales and distribution channels, such as through authorizing commercial enterprises to produce and sell greeting cards and products carrying the UNICEF Brand. Implementation of such new strategic initiatives will be done in conjunction with, or in partnership with, the National Committee.
      2. Locally developed, sourced and/or licensed cards and products carrying the UNICEF Brand are only permitted provided these meet quality, ethical, social, financial, product category and other appropriate standards specified by UNICEF as appropriate for products associated with the UNICEF Brand.
      3. In order to ensure that existing contracts and agreements regarding cards and products are respected, the National Committee will notify UNICEF of any new locally-sourced or licensed cards or products, or new agreements, which are under consideration or development. UNICEF will inform the Committee of any risk of infringement of, or incompatibility with, such existing contracts or agreements. If such a risk is identified, the National Committee may proceed with the development of the card, product or agreement only as agreed with UNICEF.
      4. UNICEF owns all UNICEF-sourced Cards and Products until sold, and the National Committee acts as the agent of UNICEF, the principal, which enjoys the protection of the privileges and immunities of the United Nations.
      5. When selling UNICEF-sourced products, a UNICEF standard Consignment Agreement will be agreed between UNICEF and the National Committee.
      6. Should either party decide that the National Committee will not be engaged in the sale of UNICEF Cards and Products, the decision must be based on a careful analysis of possible losses and gains. The other party must be informed of the decision at least six months in advance of implementation.
      7. Should UNICEF engage directly or indirectly in sales activities in the territory without the National Committee, as a result of a decision pursuant to paragraph (vi) above, this must be planned in close cooperation with the National Committee in order to make sure that such sales activities do not negatively impact on the National Committee’s other activities and will proceed only if the National Committee is satisfied that such impact can be avoided.
      8. All income from sales, including sales not made by the National Committee in the territory in accordance with paragraphs (vi) and (vii) above, will at all times be registered as income in the territory as part of the annual contribution to UNICEF from the National Committee.
      9. Variations from these provisions are only possible if both Parties agree in writing.
  12. Child rights advocacy

    1. Advocacy is recognized as an important and necessary aspect of the work of the National Committee and shall be undertaken in accordance with the principles outlined in Annex D.
    2. Advocacy is a range of activities aimed at influencing (the adoption, retention or implementation of) specific policies, practices, programmes, legislative frameworks, or resource allocations by different stakeholders, in particular governments, to advance the optimal fulfilment of the United Nations Convention on the Rights of the Child, globally and domestically. This entails undertaking foundational child rights engagement (for example, advocating for child rights principles, participation and ratification) and issue-focused advocacy, as well as utilizing globally agreed advocacy initiatives (for example, Education for Development, Baby Friendly Initiatives and Child Friendly Cities), but not the delivery of services.
    3. Advocacy undertaken by the National Committee in its own territory shall relate to the advancement of child rights domestically, regionally and internationally. The balance between these elements will be agreed in the JSP.
    4. UNICEF will provide policy support and technical guidance to National Committees and will provide access to relevant research, evidence and information in support of National Committee advocacy strategies agreed in the JSP.
    5. Within the broad strategic framework agreed in the JSP, the National Committee will establish priorities and plan and implement advocacy initiatives aligned with UNICEF global priorities.
    6. UNICEF recognizes advocacy undertaken by the National Committee within the parameters of this Agreement and the JSP, as a contribution to UNICEF’s overall mandate for children. All expenditure by the National Committee on advocacy should be accounted and proportionate in terms of investments made and results/impact achieved. Planned allocation of National Committee resources to advocacy will be specified in the JSP. The National Committee will seek to utilize, wherever possible, non-competing funding sources for advocacy.
  13. Education for Development

    1. Education for Development is recognized as an important aspect of the work of the National Committee and shall be undertaken in accordance with the framework that may be amended as agreed between UNICEF and National Committees from time to time, and in the context of strategies and plans in the JSP.
    2. Education for Development is a range of activities that promote the development in children and young people of attitudes and Values, such as global solidarity, peace, tolerance, social justice and environmental awareness, which equip them with the knowledge and skills to promote these values and bring about change in their own lives and communities and advance child rights in general, both locally and globally. Education for Development entails raising awareness about child rights, creating opportunities and space for children and young people’s civic engagement and participation, and promoting commitment to global responsibility and solidarity. The balance between these approaches will be agreed in the JSP.
    3. UNICEF will provide technical support and policy guidance to the National Committee on the substance and modalities of Education for Development, and will facilitate access to relevant research, tools, evidence and information in support of National Committee Education for Development.
    4. UNICEF recognizes Education for Development undertaken by the National Committee within the parameters of this Agreement and the JSP as outlined for Child Rights advocacy under Section 12, paragraph (f) in this Agreement. The National Committee will seek to utilize, wherever possible, non-competing funding sources for their Education for Development work.
  14. Finance provisions

    Contribution and retention

    1. The primary objective of the National Committee fundraising efforts shall be to maximize the net financial contribution to UNICEF’s programmes for children. In this context:

      1. The standard minimum annual contribution rate of National Committees to UNICEF is seventy-five percent (75%) of gross proceeds raised. Within this context, the National Committee may retain up to twenty-five percent (25 %) of gross proceeds to cover its costs. The National Committee will strive to reach this standard minimum contribution rate.
      2. Variances to the contribution and retention rates may be agreed in writing, as part of the JSP discussion, taking account of national market conditions, the level of development of the National Committee and other planning considerations.
      3. The National Committee agrees that it will engage, as part of the JSP, in a process of continuous improvement to maximize income and ensure credible and acceptable margins. The JSP will include a roadmap to achieve the above goals.
      4. National Committee financial year

      5. The National Committee financial year shall be January to December. If a National Committee, for exceptional reasons, is currently on a different financial year, it shall ensure that all financial reports to UNICEF required in Annex F shall be provided on the calendar year basis.
      6. National Committee financial statements and financial reporting

      7. The Parties agree to the Financial Reporting Requirements set out in Annex F.
      8. The National Committee will ensure that its accounts are audited by independent certified external auditors. The accounts, together with the external auditor’s certification and report, will be submitted to UNICEF within a maximum of six months of the financial year end. The National Committee will also ask the external auditors to certify the National Committee’s financial compliance with the data presented in the Final Revenue and Expenditure Report (RER).
      9. The National Committee will notify UNICEF immediately upon detection of any material or otherwise significant financial irregularities.
      10. UNICEF will provide training to the National Committee to ensure full understanding of, and compliance with, reporting requirements.
      11. Remittances to UNICEF

      12. The National Committee Will make remittances to UNICEF in accordance with Annex F.
      13. Support to the National Committee

      14. UNICEF will assist the National Committee to establish basic internal controls and policies and procedures as necessary.
      15. Reserves

      16. The National Committee shall adopt a Reserves policy that is in accordance with National Law and the National Committee Statutes and that specifies reasonable Reserve levels, taking into account the requirement of funds to be transferred for the support of UNICEF’S activities and programmes. UNICEF shall be kept informed of the Reserves policy and implementation. The Reserves policy must include the level, management strategy and planned utilization of such funds.
      17. Management of funds and assets

      18. The National Committee agrees that it will ensure the appropriate management and safekeeping and insurance of its assets and any assets it holds on behalf of UNICEF, including ensuring that it has, and follows, a low investment policy. Low risk investments are investments that are not speculative and include bank accounts, money market funds or certain government bonds or investments that are otherwise in accordance with existing National Charity Standards. Such investments, in general, include only short-term to medium-term investment periods.
      19. UNICEF will provide guidance and support as needed to the National Committee on the best way to manage funds and assets.
      20. UNICEF may at any time make a written request for information from the National Committee regarding the value, management and insurance of Reserves or any other assets and the National Committee shall provide such information in writing within one month of the request.
      21. UNICEF financial support

      22. Investment funds support from UNICEF will be agreed in the JSP or the annual investment fund procedure.
  15. Monitoring

    1. The JSP will serve as the primary mechanism for establishing the procedures for ongoing monitoring and compliance of the relationship and this Agreement.
    2. If UNICEF has reason to believe that there is material non-compliance with this Agreement it may request a financial and/or non-financial audit of the National Committee, or specific activities of the National Committee, at UNICEF‘s expense and with reasonable notice. The National Committee shall make available to UNICEF or a third party retained by UNICEF, all books, records and information in the possession of the National Committee. The National Committee will be given the report of any audits of its Committee or investigations conducted by, or on behalf of, UNICEF and the opportunity to comment.
    3. UNICEF will, as necessary and feasible, facilitate visits and discussions with the National Committee for the purposes of monitoring programmes and projects supported by the National Committee.
  16. Transparency and cooperation in maintaining an effective partnership

    1. Each Party will notify the other as soon as it becomes aware of actual or threatened events that could undermine the partnership between the Parties, compromise the reputation of either or both of them, or jeopardize the effective implementation of the JSP (including the National Committee's relationships with its donors). It is understood that the following are examples of the category of events referred to in the previous sentence: (a) media reports that have been made, or are likely to be made, that have the potential to damage the image or reputation of either or both of the Parties; (b) there has been or may have been a failure to follow established procedures of either UNICEF or National Committee procedures and policies that could cause damage to either Party; (c) either Party becomes aware of actual or threatened legal proceedings against it; (d) the governance mechanisms and procedures of the National Committee are not functioning or there are serious differences of views among the leadership of the National Committee that could compromise the efficient operations of the National Committee.
    2. If either Party receives notification from the other in accordance with paragraph (a) above, the Parties will consult without delay, normally immediately, to identify and agree on the appropriate response to the situation and, if necessary, an ongoing plan of action for each Party. It is understood that this could include advising other National Committees and the Standing Group of National Committees, depending on the nature of the situation. The Parties will cooperate with full transparency, subject in the case of UNICEF to compliance with any regulations, rules and procedures and policies that govern its relevant operations.
    3. The Parties will use the greatest discretion in any public statements about the situation, so as to minimize any damage to the UNICEF Brand, and will make all best efforts to resolve the situation as quickly as possible.
    4. Disputes, differences, and conflicts between the Parties arising out of, or related to, this Agreement and their partnership will, in general, be addressed through discussion and negotiation in a spirit of collegiality by the principal interlocutors for the two Parties, being the Executive Director of the National Committee (on the one hand) and the Director of PFP (on the other). If, despite diligent and committed efforts, these two interlocutors are not able to resolve a dispute, difference or conflict, the matter will be referred to the Chair of the Board of the National Committee and the Executive Director of UNICEF, who will agree on a mutually-acceptable process for resolving the matter, and agree on the outcome. It is understood that the Chair of the Board of the National Committee and the Executive Director of UNICEF may Wish to seek the assistance of an outside party in reaching a resolution of the matter but shall be neither expected nor required to do so.
  17. Term and termination

    1. This Agreement will be in force from the day on which it has been signed by both Parties until it is terminated in accordance with this Section 17. This Agreement may be terminated by the Parties jointly, in accordance with paragraph (b) below, or by either Party individually, in accordance with paragraph (c) below.
    2. The Parties may terminate this Agreement by mutual consent at any time. They will do so by co-signing a statement of termination of this Agreement, which will take effect eighteen (18) months after the date it has been signed by both Parties, or such shorter period as the Parties may agree. During that period the Parties will cooperate fully with each other to ensure the orderly winding up of their collaboration, transfer to UNICEF of all the net assets of the National Committee, in accordance with Section 18, paragraph (a) below and formal legal winding up of the National Committee.
    3. Each Party has the right to terminate this Agreement if it concludes in good faith that the other Party has breached the Agreement and is unwilling or unable to remedy that breach; if it believes that association with the other Party has undermined or is reasonably likely to undermine the value of the UNICEF Brand; and for any other reasonable cause taking into account the importance of the mission, mandate and reputation of UNICEF.

      1. A Party wishing to exercise its individual right of termination will do so by sending written notice to the other setting out in detail the reasons for so terminating.
      2. There will be a mandatory "cooling off" period of sixty (60) days after receipt of such notice by the Party to which it is sent, during which period the Parties will negotiate in good faith to try to reach a mutually acceptable resolution of the matter, it being understood that this can include their jointly invoking the termination right under paragraph (b) above.
      3. If, at the end of the "cooling off" period the Party giving the notice of termination still wishes to terminate this Agreement, this Agreement will be terminated as of the day ninety (90) days after the end of the "cooling off" period. During such ninety (90) day period the Parties will cooperate fully with each other to ensure the orderly winding up of their collaboration, transfer to UNICEF of all the net assets of the National Committee in accordance with Section 18, paragraph (21) below, and formal legal winding up of the National Committee. During this ninety (90) days period the Parties will use the greatest discretion in any public statements about the situation, so as to minimize any damage to the UNICEF Brand.
    4. Notwithstanding any other provision of this Agreement, the Executive Director of UNICEF may immediately suspend the operation of this Agreement or any part thereof, including the National Committee’s right to use the UNICEF Brand for any or all activities, or suspend some or all of the National Committee‘s rights or obligations set forth in this Agreement, if the Executive Director of UNICEF reasonably considers that it is in the best interests of either or both Parties to do so. The Executive Director of UNICEF will consult with the Standing Group of the National Committee as and where appropriate.
  18. Consequences of termination of the Agreement

    1. The National Committee agrees that once notice to terminate has been given by either party it will immediately take steps to remit all available National Committee assets to UNICEF or to a third party as directed by UNICEF, such as a successor National Committee (if legally permitted, or otherwise in accordance with National Law and the Statutes). Once all available assets have been transferred the National Committee shall then take all legally possible and necessary steps for its efficient liquidation Any assets that were not able to be transferred out of the National Committee prior to initiating liquidation should be, in so far as possible according to National Law, transferred to UNICEF or to a third party as directed by as UNICEF as part of the orderly winding up.
    2. Section 18, paragraph (a) above is not enforceable in the event that UNICEF no longer retains authority over the use of funds it receives from National Committees, or where notice to terminate has been given by the National Committee on grounds of misuse or misappropriation of funds, or when such remittance and closure would involve a breach of the legal duties of the National Committee or its governing body members.
    3. Upon termination of this Agreement, following completion of the required notice period, the National Committee shall immediately lose any rights with respect to the use of the UNICEF Brand that were granted pursuant to this Agreement unless UNICEF agrees in writing to a temporary continuation for the purposes of the orderly liquidation of the National Committee, and pursuant to such conditions as UNICEF may require.
    4. The Parties agree that once notice to terminate has been given they will provide all the support necessary for the efficient and effective conclusion of the relationship and the liquidation of the National Committee.
    5. Any obligations for confidentiality survive the termination of this Agreement.
  19. Transfer of rights and obligations under this Agreement

    Neither party may transfer any of its rights nor obligations under this Agreement to a third party without the written consent of the other party.

  20. Privileges and immunities of UNICEF

    Nothing in or related to this Agreement shall be deemed as a waiver, either express or implied, of any of the privileges and immunities that may be enjoyed by the United Nations and UNICEF.

  21. No waiver of rights

    The failure of either party to exercise or enforce any right conferred under this Agreement, or failure to act on any breach by the other party, shall not be deemed to be a waiver of any such rights to pursue action at any time thereafter unless the provision specifically stipulates a time limit.

  22. Language

    The language of the Agreement and any dispute proceedings is English. The National Committee shall ensure it has sufficient capacity to communicate in English. Whenever information that is shared is a translation, the original language version shall also always be transmitted to the other party.

  23. Interpretation of Agreement

    1. The National Committee is governed by National Law and it is agreed that nothing in this agreement can override its requirement to comply with National Law. In particular, nothing in this agreement shall require the National Committee to act in a manner that may threaten its charitable status or tax exempt status or equivalent under National Law. In all cases, the Agreement should be read in light of this provision, to the extent that such an interpretation cannot be made, that part of the provision will be ignored.
    2. This Agreement shall be interpreted and governed, in order, by (i) its terms and provisions and the underlying policy thereof, and (ii) the policies and practices of UNICEF and the United Nations system generally.
    3. Notice or written agreement as used in this agreement can be by post, facsimile or by electronic messaging. In the case of electronic messaging, an acknowledgment of receipt must be provided by the recipient for the notice to be valid.
  24. Status of the Agreement

    This Agreement supersedes and replaces all previous Cooperation Agreements, including supplementary agreements between the Parties unless specifically noted otherwise in this Agreement or agreed in writing. The Parties may choose to enter into supplementary agreements subsequent to this Agreement, however, such supplementary agreements must be interpreted in accordance with the provisions and the spirit of the provisions set out in this Agreement.

  25. Confidential information

    All confidential information shared between the Parties shall remain confidential as between the Parties and the National Committee community, unless the other party has given clear consent, or the information has already been released by the other party in the public domain, or a party is legally obliged to disclose, in which case it shall make all reasonable efforts to provide the other party with prior notice. The existence of a dispute between the Parties is also confidential to the National Committee community although the Parties may disclose the fact that a conflict resolution process has been established without providing any details as to the nature or content of the discussions if that party considers in good faith that it is in their best interests to disclose this fact to third parties.

  26. Annexes and attachments

    The following Annexes are an integral and binding part of this Agreement:

    Principles of child rights advocacy

    JSP procedure

    Signature of this Agreement and initialling of the respective cover pages of the Integral Annexes constitutes formal approval of the Integral Annexes and an agreement to be bound by their contents. The Parties agree that the Integral Annexes may be amended as agreed in writing between the Parties from time to time without re-execution of the rest of the Agreement. The Standing Group, or representatives appointed by the Standing Group, will represent the National Committees and coordinate the National Committee community position on any amendments to an Annex; however, agreement in writing by both Parties to the final agreed amendments is required.

  27. Amendments to this Agreement

    This Agreement and the Integral Annexes can only be amended by written agreement of both Parties.

    The Parties agree that this Agreement will be reviewed in 2015 by UNICEF and the National Committee community in consultation.

日本ユニセフ協会に関するデマがますますひどくなっていく

日本ユニセフ協会に関するデマは、日を追うごとにますますひどくなっていく。

ユニセフ(UNICEF, 国連児童基金)は、その名の通りニューヨークに本部を置く国連機関であり、その職員は、国際公務員にあたる。このユニセフの日韓方面の活動を担当するのが、神宮前にあるユニセフ東京事務所。職員(国際公務員)はわずか11名しかいない。

もちろん、たった11名で日韓両国の支援活動を回すことは不可能なので、日本と韓国、それぞれの協力団体と協定をむすび、提携している。それが高輪に事務所をかまえる日本ユニセフ協会と、ソウルの韓国ユニセフ協会。日本ユニセフ協会は公益財団法人なので、職員は国際公務員ではなく、団体職員となる。職員数は66名。

日本ユニセフ協会(Japan Committee for UNICEF)は、ユニセフ東京事務所から“ユニセフ”と称することを公認された国内唯一の団体であり、日本国内の募金事業をはじめとする支援活動の全面的な委託を受けている。おそらく韓国ユニセフ協会も同じだろう。日本ユニセフ協会、韓国ユニセフ協会がそれぞれの国で募金活動を行い、それをユニセフ東京事務所を通じて、資金を必要とする地域に送るのである。

またアルファルファか…

昨日、こういうデマを見かけた。アルファルファモザイクが、日本ユニセフ協会のウェブサイトから以下を引用して「日本ユニセフ協会は、日本で集めた募金を韓国に送金している」と主張している。もちろん、デタラメだ。

ユニセフ東京事務所の現在の主な活動は、以下の通り。

  • 「子どもの権利条約」、「ミレニアム開発目標」、「ユニセフ中期事業計画(2006-2013年)」を枠組みとして、日本のODAによる国際開発協力事業とユニセフの現場でのプログラムの連携を促進する。
  • 国際開発協力を推進するさまざまな研究機関や学術団体、NGOとのパートナーシップ強化を通して、プロジェクト実施に貢献する。
  • ユニセフのプログラム分野に関するセミナーやワークショップを開催する。
  • 日本政府無償資金援助、及びJICAとユニセフのマルチ・バイ協力に特に力をいれ、ユニセフ現地事務所とのネットワークを通して、世界各国で子どもと女性を対象とした、感染症対策・母と子の保健改善・教育・社会開発などの分野で協力している。
  • 超党派の国会議員で構成されるユニセフ議員連盟のアドボカシー活動を支援する。
  • 韓国政府をはじめとする韓国のパートナーとの関係強化をはかる。

ここで取りあげられているユニセフ東京事務所とは、上記の通り、国連機関であるユニセフ本部のおく事務所であり、日本ユニセフ協会の事務所ではない。このページでも「ユニセフ東京事務所はニューヨーク本部直轄の国際機関事務所」と明記されているし、さらに「民間への窓口としての役割を果たす公益財団法人日本ユニセフ協会と密接に協力」ともあるから、ユニセフ協会の事務所でないのは、一読してすぐに分かると思うのだが…。

また、「韓国政府をはじめとする韓国のパートナーとの関係強化をはかる」とは、言うまでもないが、日本で集めた募金を韓国に送金することではない。上記の通り、韓国ユニセフ協会と連携して支援活動を行う、という意味である。どこをどう読めば韓国に送金することになるんだ?

アグネス・チャンさんは無償奉仕

ユニセフ親善大使のアグネス・チャンさんがその活動を通じて利益を得ている、というデマも根づよい。ユニセフ本部が指名任命した黒柳徹子さん、日本ユニセフ協会が任命したアグネス・チャンさん、医師の日野原重明さんは、いずれも無報酬で広報活動に従事している。豪邸など建たない。

ちなみに韓国では、フィギュアスケート選手のキム・ヨナさんが本部指名の親善大使、俳優のイ・ビョンホンさんやウォンビンさんらが韓国ユニセフ協会の指名した親善大使である。こちらも無報酬だ。上述の通り、韓国にはユニセフ直轄の事務所が置かれていないので、キム・ヨナさんの親善大使としての活動を手配しているのは、東京事務所ではないかと思われる。

黒柳徹子さんの口座は個人口座

2ちゃんねるの創業者・西村博之さんが、「なぜ黒柳徹子さんの振込先口座を紹介しないのか」とアグネス・チャンさんに公開質問状を出しているが、これは無茶な話ではないだろうか。アグネス・チャンさんは、日本ユニセフ協会の依頼をうけて広報活動を無償で手伝っているだけの芸能人であり、協会の職員ではないから、協会の方針についてなんらかの公式な回答をできる立場ではないだろう。

黒柳徹子さんは、みずから銀行口座を開設して募金を集め、それをユニセフ本部に送金している。が、これは黒柳徹子さんが個人の善意としてやっていることであり、ユニセフの公式な募金ルートではない。だから、アグネス・チャンさんがユニセフ親善大使の職務として、黒柳さんの口座を公式に紹介できるわけがない。

また、黒柳徹子さんの口座は個人口座であるから、ここに寄付しても所得税の寄付控除は適用されないことにも注意が必要である。「1円でも多く送りたいから」と思って、黒柳口座に振り込んだのに、そのうち何%かは所得税として引かれてしまうわけだ。

[追記] もしかして分かりにくいかな…と思いつつそのままにしておいたが、案の定はてブで突っこみがあったので、やはり書いておく。寄付控除はもちろん寄付する側に適用される。公益財団法人である日本ユニセフ協会に寄付した場合、その金額に対して寄付控除が適用されて、あなたが納付すべき所得税額も少なくなる。黒柳口座に寄付したいときは、寄付控除が適用されないので、その金額に対しても所得税が課せられることになり、あなたが寄付のために使える金額は少なくなる。[/追記]

オレが個人的に不審に思うのは、「日本ユニセフ協会は、会計が不透明だ。ピンハネしているのではないか?」と主張する人たちが、同じ疑いを黒柳口座に対しては抱かないことだ。つまり、かれらが求めているのは会計の透明性ではない、ということだろう。

なお、日本ユニセフ協会は、財務諸表をウェブサイト上で公開している。「会計が不透明だ」と大げさに騒ぎたてる人ほど、じっさいは見ていないものである。

ユニセフ本部が善で、日本ユニセフ協会が悪なのか

こうした日本ユニセフ協会に関するデマをながめてみると、ほとんどがユニセフ本部を善、日本ユニセフ協会を悪と、あたかも真っ向から対立する組織であるかのような想定をしている。まったく、バカバカしいとしか言いようがない。実態は、すでに紹介した通りだ。

そのうえ、それらのデマを指摘すると「お前はあの許すまじきユニセフ協会を擁護するつもりか!」などと顔を真っ赤にして突っかかり、いかにユニセフ協会が偽善に満ちた悪の組織であるかについて、えんえんと熱弁を振るおうとする人たちがいるので、本当に面倒くさいことこのうえない。

あれを偽善だと思うなら、自分の信じる善行をやればいいじゃん。

MailOnline の独占スクープ。クレイグ・コッブ氏(62)は、米国ノースダコタ州の小さな町を「白人の飛び地」にして黒人を追い出せと主張する、白人至上主義者だ。そのコッブ氏が、アフリカ系の女性トリーシャ・ゴダードさんが司会をつとめるテレビ番組『トリーシャ・ショー』に出演し、DNA検査を受けた結果、かれが14%のアフリカ系の子孫であることが番組中で明らかになった。

間違った科学を是正すると称する偽りの科学は科学修正主義だろう

間違った歴史を見直すと称する偽りの歴史が歴史修正主義(Historical revisionism)であるなら、間違った科学を是正すると称する偽りの科学は科学修正主義(Scientific revisionism)だろう。

いずれも、われこそが科学なりと称し、非科学的な目的をもって、非科学的な手段をもちい、正当な見解への攻撃を試みるのが共通点である。

たんなる見解の相違ではなく、目的と手段の過ちをいう。したがって、たんに主流説に対して懐疑的というだけの主張をこれには含めない。「○○説は間違っている」という主張、それ自体のしかたが間違っていても修正主義には含めない。いわゆる「トンデモ」は、ただ面白いというだけであり、修正主義ではない。

「○○説には証拠がない」「この証拠は捏造されたものだ」といったそれこそ根拠のない言いがかりや、「○○説の論者はこれこれかような人物だ」「○○説を支持する連中はどうかしている」といった人格攻撃、「××説を支持しない学会は閉鎖的」「かれらは××説の正しさを恐れているのだ」といった被害妄想や誇大妄想などが、科学修正主義にあたる。

話法としては、うそ、論点のすりかえ、無知への居直り、恣意的な懐疑、相殺論、極論などを多用する。

繰りかえすが、科学修正主義は、おかしな主張をしている(トンデモ)というだけではない。「あいつらはおかしな主張をしている」という、おかしな主張をいう。

つまり、根拠にとぼしく主流説となれなかったもの、おかしな主張をしているもの、おかしな主張を批判すると称しておかしな主張をしているもの、これらはすべて別ものであるということだ。

修正主義は、論述姿勢の正統性を僭称している点が、ただのトンデモとは違っている。

【舞田敏彦】博士課程修了者の多くが行方不明・死亡したと称するデマについて【またお前か】

先日、このようなツイートを見かけた。

大学の博士課程を修了した者が、その後、正規雇用されず、多くが不安定な職業に甘んじたり、死亡したりした、とするツイートである。行方不明者がいるとまでは言っていないが、そのように誤読する者も多かった。

このツイートに対する主たる反響は、次のようなものであった。

結論からいうと、完全なデマである。


「博士が100にんいるむら」

このデマはかなり以前から流行しているもので、オレの知っているだけでも、すでに2005年には大流行していた。もしかしたら、それがこのデマの誕生の年かもしれない。しかし、これはリアルタイムに検証されてデマであることは明らかになっていた。

このデマは当初、「創作童話 博士(はくし)が100にんいるむら」という名前で流通していた。内容はほぼ同じである。博士課程の修了者のうち、約8%が「ゆくえふめいか、しぼうしています」とするもので、もちろん言うまでもなくデマである。

この「創作童話」と称するデマは、数字が極端すぎる上、データの出所を明らかにしていない。こんな荒唐無稽なデマを信じるほうがどうかしている。

このデマはただちに検証され、文科省の「学校基本調査」がネタ元であることが明らかになっている。

「学校基本調査」を見ればすぐに分かることだが、ここで約8%と言っているのは、以下(平成25年度版)の通り、「卒業後、調査期日の5月1日までに死亡した者と、学校で卒業後の状況がどうなっているかまったく把握できていない者」のことである。

3月末に課程を修了して5月1日までに死亡する者はかなり少ないと考えられるので、大半は卒業後の就職状況が不明、つまり、たんに「調査票が返却されなかったか、連絡先が分からないので、データを取得できなかった」というだけである。どこにも「行方不明になった」などとバカげたことは書かれていない。

手品のタネが分かれば、「なあんだ」というだけのことだが、デマのデマと呼ばれるゆえんは繰りかえされる悪質さにある。


社会統計学専攻と称するデマ常習犯

「データえっせい」と題するブログがある。筆者・舞田敏彦のプロフィールを見ると、次の通りである。

舞田敏彦
1976年生まれ。東京学芸大学大学院博士課程修了。博士(教育学)。武蔵野大学,杏林大学兼任講師。専攻は教育社会学,社会病理学,社会統計学。

これを見ただけならば、たいそう立派な人物であるかのように思える。社会統計学などを専攻していたとのことで、その方面には詳しいのだろう。ところがこの人物は、とんでもない大ウソつきであった。

舞田敏彦は、2012年に「博士が100にんいるむら」と同様のデマを流している。

記事のタイトルを煽情的な「~の惨状」とした上で、「(8)死亡・進路不明」を勝手に「死亡・行方不明」と読みかえて、不安を煽りたてている。かれは単なる書きまちがいだと言い訳するかもしれないが、ここだけが切りとられ、一人歩きして、当時はそうとうTwitterを賑わせたものである。

すぐに多くの批判が寄せられたが、大半は語彙の改竄についてではなく、統計処理の方法についてであった。そのため舞田敏彦は数日後、「分析の不備を補正する」と称してブログ記事を書いたが、けっきょく「進路不明」を勝手に「行方不明」と読みかえたことについては、謝罪も撤回もしないままであった。


すでにお気づきだろう。

冒頭に引用したツイートは、このデマ記事を書いた舞田敏彦、その人のものなのである。また、おまえか。

舞田敏彦は、このツイートの反響が大きかったので気をよくしたのか、ブログ「データえっせい」に補足記事を書いているが、もちろん、言うまでもなくデタラメである。

かれはこの記事で、「不詳・死亡」の内訳について「おそらくは,連絡が取れないなどの理由による進路不詳者であると思われます」と説明している。つまり、かれが2012年に書いた記事で、あたかも行方不明者であるかのように書いていることが、間違いであると分かっているのだ。そのような批判があり、それを知ったうえで訂正していないのである。

オレが、かれを悪質なデマ屋と考える理由の1つである。つまり、ウソをウソと知りつつウソを吐くこと、である。

舞田敏彦はこれに続けて、「でも,行方不明者も結構いそうだなあ」とも書いている。この期に及んでまだ不安を煽りたてるのか。かれは読者がそのように誤読することを望んでいるのだ。いくらなんでも、これは呆れはてるほかない悪意に満ちた文句ではないだろうか。しかも、2012年にバレたウソでありながら、この2013年にふたたび繰りかえしている。

悪質なデマ屋であると考える理由の第2である。つまり、すでにバレたウソを何度も繰りかえすこと、である。

舞田敏彦は、自身のツイートがあたかも死亡者・行方不明者が多発しているかのような誤読をされていることを知っている。にもかかわらず、その誤読の広がりを止めようとはしていない。むしろそれが拡散することを積極的に支援している。たとえば上記の「ハムスター速報」を、舞田敏彦はTwitterで紹介している。まったく批判は加えていない。

オレが舞田敏彦を悪質なデマ屋と考える3つ目の理由である。自分のせいで広まっている誤読を抑えようとしていない。

おかしなグラフ

舞田敏彦が、冒頭ツイートにかかげるグラフにも問題がある。各専攻の人数が明らかにされていない。統計を専門的に行う者なら、サンプルのサイズやその偏りはとうぜん考慮するはずだが、舞田敏彦は社会統計学を専攻したと称しながら、まったく考慮した形跡がない。

2013年の調査対象となった学部別の学生数は、55万8853人である。一方、博士課程の修了者数は、わずか1万6440人である。約34倍の差がある。これだけサンプルサイズが異なるのに、同程度の精度で比較できるとでも言うのだろうか。

おなじ博士課程でも、専攻によってもサンプルサイズが違う。最多は保健の5261人、次いで工学は3668人である。少ないほうでは家政が82人、芸術が133人である。修了者133人のうち進路不明者が35人いるからといって、統計上、そこにどれだけの意味があると言えるのだろうか。ちなみに、社会科学の学部生は19万5024人である。

また、学部卒業生と博士修了生を比較していること自体が、そもそもおかしい。3月末に卒業した者が、5月1日までに就職しているとすれば、それは卒業前から就職が内定しているのである。学部生の新卒入社が多いのは当たり前のことではないか。一方、博士課程を修了した者は、進学者が少ないのは当然のことだし、教育機関に就職するにしてもいきなり教授や准教授になるわけではない。いちど非常勤講師などをへてキャリアアップするのである。非常勤講師はもちろん「非正規就職」である。これを比較しようなどと考えることが、そもそもバカげている。

だいいち、進路不明者をグラフに含めちゃいけないよ。不安定進路なのかどうか、文字どおり「不明」なんだから。こういうのは、まっとうな論者なら無効データとして扱うべきものだ。まっとうな論者でないなら、…まあ、しかたないな。

グラフは、数字が差ししめす事実を視覚的に分かりやすく伝えるためのものである。舞田敏彦は、われわれに何を分からせようとしているのか。


社会統計学を専攻したと称し、「データえっせい」なるブログを書いている舞田敏彦が、これを有効な統計分析と考えているわけではないだろう。要するに、それがデタラメであると承知した上で、故意に煽動しようとしているのである。

なぜ、そのようなふざけた真似を繰りかえすのかは分からない。

あくまでも想像だが、舞田敏彦は社会不安を煽りたてることで世間の注目を集め、それにより自著や、あるいは自分自身を売ろうとしているのではないだろうか。そうとでも考えなければ、こうした不可解な行動はあまりに説明がつかないのではないか。

アホくさいので、寝る。

こやつは、2011年にも同じデマを飛ばしていた。このころは、幸いにして鵜呑みにするものは少なく、行方不明ではないと指摘する声があった。

舞田敏彦じしん、「およそ6人に1人。その仲間入りはしたくないものです。母校からの進路状況調査には,きちんと回答しようと思います」と書いているから、調査票を返却しなければ進路不明として処理されることが分かっているのだ。行方不明者でないと知りながら、「行方不明の博士」と書いている。そう書いたほうがセンセーションを引きおこせる、と考えたからだろう。

舞田敏彦はSYNODOSに寄稿している。まじか。ちょっと驚いたよ。舞田敏彦が勝手に送りつけたのか、それともSYNODOS側から寄稿を依頼したのだろうか。

おそらく「サンプルサイズ」(標本の大きさ)と書くべきであろうところを、「サンプル数」と書いている。

学校基本調査の捕捉率の低さはすでに指摘されていた(11月12日 3時)

当ブログのコメント欄にて、非常に詳細なご意見をいただいた。舞田敏彦が悪用した学校基本調査(および進路実態調査)にはもともと調査手法の不備があり、学部卒業生や博士修了生の進路動向を十分に調査できておらず、「進路不明」が過大に計上されているという。さらに文科省の委託をうけた日本総合研究所による調査手法に対する検証と、追加調査が行われたとのこと。

また、舞田敏彦が2012年9月4日に「補正」と称するブログ記事を公開したあとも、大学でデータ分析などを教える専門家の太郎丸博さんに「あまりのアバウトさ」「統計マジック」などと指摘されていることも、あわせてご紹介いただいた。

上記のご紹介いただいた資料を一瞥すれば、まっとうな理性を有する人間がどちらの主張に拠るべきかは、ほぼ自明のことと言えそうだ。

このことによって、舞田敏彦はかのデマを流すことができなくなった。おなじウソを繰りかえせば、故意犯であることが確かめられるからだ。[追記]オレのツイートを認識していると言えても、このブログ記事に気づいたとまでは言えないかな。ただ、かれが反論めいたことを言わないのは、おそらくブログ記事を見ているからだろうと思う。[/追記]

舞田敏彦がツイートを削除せよと要求してきた(2014年1月23日 18時)

オレが問題と考えるのは、舞田敏彦がウソと知りつつそれを流布する故意性なのだから、かれがデマ記事を削除すれば、とうぜんオレの発言も存在意義を失うのだが(オレは削除する意志がありますよと表明している)、かれは何がなんでも自身のデマを撤回したくないようだ。

注目すべきなのは、かれが問題視するのは“匿名で「死んだほうがいい」などと人を罵る行為”であって、たとえば顕名による罵倒であれば許容できると考えているらしいことだ。ただし、これはかれの本音ではないだろうと想像している。かれは自身が批判されたこと自体を怨みに思っていて、しかし反論のすべがなかったために批判者の匿名性と罵倒表現にかこつけている、というのが本当のところではないだろうか。

すでにお気づきだろうと思うが、かれはこれまで一切、このブログ記事やその内容に触れていないし、URLも書かない。かれの読者は批判意見の存在を知らされていない。そこからすると、かれはこれからも継続して職業的デマ屋として活動にいそしむ意志があるとみてよさそうだ。

*追記。この人物に当該ツイートの削除要請をしたところ,この人物が反論を寄せたブログ記事を削除することが条件などと言ってきました。そういうこと以前に,匿名で「死んだほうがいい」などと人を罵ることに,何の罪悪感も感じていないようです。

  この “ yunishio ” なる人物は,私が反論に応じないことを問題視しているようですが,匿名の反論など「論」とは認めません。

  もう,やれるだけのことはしました。あとは,ツイッター社からこの非道者に鉄槌が下されることを願うだけです。

ここで問題視していることは「反論に応じないこと」などではなく、ウソと知りつつそれを流布する故意性だよ。

また、かれはここでも“匿名の反論など「論」とは認めません”と言っていて、要するに批判者が匿名であることが唯一の反抗の足がかりとなっている。ちなみに「論とは認めない」と言いつつ、同時に一方で「匿名の反論」とも言っており、かれ自身が「論」であることを認めてしまっている。オレはオレ自身の書いたものを「反論」とは呼んでいない(まあ、結論という語彙は使ってるけどね)。

【デマ続報】「もったいない」か「役得」か、余った「給食」を食べていた保育所調理員たちの行為は“悪”なのか

産経新聞(大阪本社版)で以下のような報道がありました。

兵庫県の西宮市で、公立保育所の余った給食を調理員らが食べていたので、市議が問題提起した、というものです。この報道を受けて、さまざまなサイトやブログで取りあげられました。代表的なものを以下に挙げます。

西宮市の公立保育所において調理員らが給食を食べている、という問題については、昨年12月にも共同通信が取りあげて話題になったことがあります。この共同報道にしても、今回の産経報道にしても「余った給食を破棄するのはもったいないのではないか」、いわば「もったいない論争」が提起されているような書きかたです。

前回報道のときは、「こんなくだらないことを取りあげた市議がいる」といった糾弾や侮蔑のニュアンスを伴う、なかば中傷ともいえるような反応が市議や市役所に寄せられました。

しかし、この問題を提起した西宮市議・澁谷祐介さんは、そういう視点だけから取りあげているわけではありません。

澁谷市議が指摘しているのは、「一部の正規調理員に職務怠慢があり、仕事を保育士や臨時調理員などに押しつけ、子どもの養育を軽視しており、保育所長らもそれを知りながら是正しようとしない、これは組織的な問題なのではないか」ということです。

今回報道でも触れられている「内部告発」については、すでに澁谷市議のブログにて紹介されていますし、当ブログでも書き起こしをしたことがありました。

当ブログで書き起こした告発のうち、代表的なものをいくつかご紹介しておきます。

保育所の給食は塩分摂取量がきまっているはず。それをもとに管理栄養士が計算して献立を決めているのに、醤油・油、塩などの調味料は大目に入れていた。献立どおりするとまずいから、自分の舌で調整しながら作るように指導された。これはどうなのか??毎回私が作る分には味が薄いと濃くするように命じられた。完璧な数字で調理はできないが、保育所は薄味調理でないといけないと思っていました。職員の好みで、ましてや自分たちが食べるために濃い目の味付けはおかしいです。

■■■■さんに発注していたかつおだしはかなり高級で驚きでした。昆布だしも高級でした。それを週に2袋使っていました。金額は不確かですが、保育所給食に必要なのでしょうか?使い方も豪快で、まさしく税金の無駄遣い!給食費の無駄遣いに感じました。

15時から16時は事務処理を理由に休憩室に入っておやつを食べながらくつろいでいました。事務処理のないプールさんや嘱託Bは横になって寝ていることもありました。私と職員は簡単な事務処理なのですぐに終わり、16時までゆっくりすることが多かったです。とにかく休憩は多かったです。16時からおやつの片づけをし、16時半には必ず休憩室に入り、45分を待ちながら着替えていました。明らかに保育士も所長もわかっていたと思います。

所長に職員の仕事ぶりに理解できないと相談しに行った時、私に「所長会でも、調理員の悪態や、組合が強いことで、所長達も困っていることが、実際に問題点として上がっている。」ともらしていた。この時、明らかに保育所運営上、調理員が協力しないことなど、以前から所長自身、把握していたことが分かった。

土曜日は私が配属されてからずっと2人勤務でした。実際に園児は多くて30人弱程しか登園しておらず、ずっと1人でも十分に仕事が出来ていたのにも関わらず、大変だということを所長にアピールし、2人勤務を了承させていた。全くの人件費のムダ使いだと思っていました。

長年勤務していたプールさん、嘱託さんが、嘱託Aは職員が楽するために導入された制度やと言っていた。これだけ仕事をしない職員を手助けするAは必要なのか、疑問に思った。

現業職の組合はこれほど劣悪な職場環境をつくっていた職員の実態を把握していたのか。その上でまだ雇用を守るのか!?

ここで引用したものはごく一部でしかありませんが、これだけでも、たんなる「もったいない論争」ではないことがお分かりいただけるのではないでしょうか。

総合すると、「正規職員と、その他の嘱託職員などの待遇に格差があり、正規職員は自分たちが働きたくないので嘱託職員らに仕事を押しつけ、給食を作るときも自分好みの味つけや分量に変え、自分が食べたい分だけ先に取るので子どもたちに行きわたらないことがある」というものです。

今回の産経報道について、澁谷市議は「今回の記事は、とても丁寧」「これまでもいうべきことは適宜ブログに書いてきたので、特にコメントはありません」としていますが、「役得」という視点が持ちこまれたとはいえ、上記の論点がていねいに掘りさげられたものでないことに変わりはありません。

決して、たんなる「もったいない論争」ではないですので、ご注意ください。
