エコーニュースがデマを流している

エコーニュースなるウェブ媒体が、チャットアプリLINE(LINE社は無料通話・メールアプリを謳っているが、実質はチャットアプリだろう)に関するデマを流している。名誉毀損ないしは業務妨害にもなりかねない。そこで、かれらの主張が間違っていることを指摘したところ、かれらは訂正するどころか、さらなる名誉毀損によって批判者の信用を毀損しようとこころみた。その一連の経緯を振りかえってみる。

最初に見かけたのが、このツイート。新聞業界でもよく見られるが、ユーザー数の水増しは広告主に対する詐欺行為といってもいい。とうぜん関心をもって記事を読んでみたところ、言いがかりもいいところであった。(以下引用の強調は筆者による)

LINEが今年4〜9月分のリリースで出していた資料によれば、日本国内ユーザー5000万人のうち59.2%が「毎日利用しているユーザー」のハズだった(約59%である)。

しかしながら、昨日の発表によるとこれまで世界中で5億と公称していたのはダウンロード回数に過ぎず「一ヶ月のうちに利用しているユーザーは1億7000万人に過ぎないとされる(約28%である)。

アクティブユーザーの比率に倍以上開きがあるがこれはどうしてだろう。まず今までLINEが主張してきた日本国内の利用者数は「日本で5000万人」だ。とすると、間違っても「ダウンロード回数」ではなくてユーザー人数のはずである。資料を普通にみれば、5000万人がユーザー(つまり5000万はダウンロード回数のことではない)としか読めない。すると、「日本人は59.2%が毎日利用するほどLINEが好きだが、他の国も合わせると一ヶ月のうちでもたった28%しか利用していない」ということになる。これは、よほど 国内外でLINEへのハマり方がちがっているのか、それとも発表がおかしいのかどちらがである。

そして何より問題なのはLINE社が、「4週間で2000万円から3000万円」のスポンサードスタンププランという広告を、ユーザー数が5億と媒体資料で銘打って販売していたことである。もし、ユーザー数に大きな齟齬があってこの高額な広告を売りつけていたら、それは詐欺だ(上記画像は2014年4〜9月媒体資料)。同社は、これまでのお客様のためにも実際のユーザー数を早くから公表するべきであったし、これからでも遅くないから発表出来る情報をクライアントに伝えて、実ユーザー数と相違した分に案分した広告費用を返還するべきである。

かれらの主張は、「LINE株式会社はこれまで5億人のユーザがいると公称し、広告主向けの媒体資料にもそのように書かれていたが、昨日の発表によるとその5億なる数字はダウンロード回数にすぎない。つまり5億のうちほとんどは利用の実態のない水増しの数字である」というものである。

これが、とんでもないデタラメであった。

ここにいう昨日の発表とは、日経新聞のこの記事のことだが、ここで5億とは「登録ユーザー数」のこととされている。ダウンロード回数ではない。この時点ですでに、かれらの主張の前提が崩れている。

 無料対話アプリのLINE(東京・渋谷)は9日、事業戦略発表会「LINEカンファレンス」を開き、登録ユーザー数が世界で5億6000万人を突破したと発表した。この中には登録したものの、現在は利用していない人も含まれる。実際の利用状況を示す月間アクティブユーザー数(MAU)は1億7000万人と初めて公表した。

 競合アプリのMAUは米フェイスブック傘下の「ワッツアップ」が6億人、中国のネット大手、騰訊控股(テンセント)が手掛ける「微信(ウィーチャット)」が4億3800万人となっている。

では、LINE社の2014年4-9月期の媒体資料にはどう書かれているか。まず、いきなり2ページ目に「2014年は5億ユーザーへ」「2014年は5億人到達を目標としております」と書かれている。ダウンロード回数などとは書かれていない。登録ユーザ数とする日経記事とは、なんらの矛盾はない。エコーニュースの記者はかの日経記事を読んで、なにを発見したつもりになったのだろうか?

とはいえ、この「5億人」がダウンロード人数(回数ではなく)であって、登録ユーザ数やアクティブユーザ数を表すものでないとすれば、かなり広告主の誤解を招きやすいか、あるいは故意に誤解を誘おうとしていると疑ってみるのも合理的だといえる。この時点では。

では、媒体資料にはどのように書かれているか。国内利用者数を「5000万人+OVER」「日本の人口の39.1%」としている。そして、アクティブ率(毎日利用してるユーザー)を59.2%としている。どこに誤解の余地があるだろうか?LINEへの広告主は、国内ユーザが5000万人いて、そのうちアクティブユーザが約3000万人であることを、まったく誤解の余地もなく把握できるのである。

広告主が関心をもつのはアクティブユーザ数であり、LINE媒体資料ははっきりとアクティブユーザ数が約3000万人であると明言している。そして、この資料にいう国内ユーザ数というのも、日経記事にいう登録ユーザのことであることが分かる。

おそらくエコーニュース記者は、日経記事にいう登録ユーザー数をダウンロード回数と誤読したまま、5億の利用実績がないと早合点したに違いない。そこでオレがそのことを指摘したのだが。

「MAU中のDAUが59%になる」うんぬんは、たぶんオレの勘違い。

LINE媒体資料は「人」と書いているから日経記事との齟齬はない、という指摘をしたつもりなのだが意図が通じていないようだ。おそらく、この時点においても日経記事が「ダウンロード回数」と書いていると思いこんでいる。

そしてこの直後、エコーニュースは驚くべき行動に出たのである。

なんと、オレがNAVERまとめの利用者であることをもって、回答を拒否したのである。言うまでもないことだが、言わなければ分からない人間もいるのでわざわざ言っておくが、オレがNAVERまとめの利用者であるかどうかということと、かのエコーニュース記事が事実に反しているかどうかはまったく関係がない。かれらの誤った記事がひとりでに正しくなることなどありえないのである。

しかし、かれらの真の狙いはまた違ったところにあるのだろう。とどのつまり、あいつはLINE社と利害の一致する関係を有しているのだ、あいつはLINE社を守るためにウソ八百を言っているに違いないから耳を貸す必要はないのだと、かれらの追従者に信じさせ、自身の誤りをごまかしたいのだ。だから、わざわざ目を引くような画像をこしらえてまで追従者に見せつけるのである。

エコーニュースとは、いったい何ものであろうか?かれらのサイトによると、構成メンバーは以下のようである。(編集長の江藤貴紀氏は、「伊藤弘文」という別名を用いることもあるようである。)

このTwitterアカウントの過去の投稿を見ればすぐに分かることだが、かれらは、なぜだかは知らないが、LINE株式会社に対して異様な敵意を持っているようである。

ところで、オレはこのエコーニュースを「デマ体質」を持った媒体だと考える。デマの発生源となり、あるいはまたデマの媒介者となる、デマゴーグの資質を十全に満たしているからだ。オレの考えるところでは、デマゴーグの資質とは以下のとおりである。

敵が存在する
客観的に見て、それが「敵」と呼びうるかどうかは別として、かれらの主観として憎むべき「敵」が存在する。あるいは憎んですらいないかもしれないが、少なくともそれは、身内では「敵」と見なされ、実際そのようにあつかわれる。
敵の主張を理解しない
かれらは「敵」と見なした相手の主張に耳を貸さないか、あるいはひどく誤解するか、あるいは極端に曲解する。その誤解や曲解はつねに敵対性が強まる方向にであって、和解の方向にはされない。ましてや自身の誤りを訂正する方向には、決して読みとらない。
敵の陰謀を疑う
かれらは「敵」がただならぬ野心を持ち、陰謀をめぐらせていると信じている。「敵」の言動からは、つねに悪意を見いだそうとする。とうぜん偶然の結果などは信じず、かならず背後に「敵」の計算があるはずだと疑ってかかる。
批判者はスパイである
かれらは自身の誤りを指摘する批判者がいれば、それを「敵」のスパイと考える。もちろん、批判者が身内の者であっても、「敵」の回し者である。その結果、身内からは価値観の多様性が排除され、極度に画一化、純粋化する。

これは、オレの考えるカルトの特徴ともほぼ完全に一致する。というよりは、デマゴーグのウソに付きあう人々が集まってカルト集団を形成するのだ、と考えたほうが分かりやすいだろう。

Concluding observations on the combined seventh to ninth periodic reports of Japan*

* Adopted by the Committee at its eighty-fifth session (11-29 August 2014).

  1. The Committee considered the combined seventh to ninth periodic reports of Japan (CERD/C/JPN/7-9 ), at its 2309th and 2310th meetings (CERD/C/SR.2309 and 2310), held on 20 and 21 August 2014. At its 2320th and 2321st meetings, held on 28 August 2014, the Committee adopted the following concluding observations.

A. Introduction

  1. The Committee welcomes the timely submission, in a single document, of the State party's seventh to ninth periodic reports drafted in conformity with the treaty-specific reporting guidelines. The Committee notes the oral presentation and the responses provided by the large delegation during the consideration of the report as well as additional information provided in written form.

B. Positive aspects

  1. The Committee notes with interest some administrative and political measures taken by the State party since its last periodic report, which should contribute to combating racial discrimination, particularly the adoption of Japan's Action Plan to Combat Trafficking in Persons, in December 2009.

  2. The Committee also notes with interest that, since it last considered a periodic report from the State party, Japan has ratified the following international instruments:

    1. The International Convention for the Protection of All Persons from Enforced Disappearance, on 23 July 2009;
    2. The Convention on the Rights of Persons with Disabilities, on 20 January 2014.

C. Concerns and recommendations

  1. The Committee recalls that in its Concluding Observations of 2010 it had requested the State Party “to address all the points raised in the present Concluding Observations”. Other than responses to the three concerns expressed in paragraphs 12, 20 and 21, as found in the State Party's follow-up document in 2011, there was no reference to the 2010 Concluding Observations in its report.

    The Committee strongly recommends that the State party address all the Concluding Observations contained in this document in its next periodic report.

Ethnic composition of the population
  1. The Committee, while taking note of data on the ethnic composition of its population provided by the State in its report as well as in its core document, regrets that such data are not comprehensive, in particular with regard to vulnerable groups, including non-citizens, so that the Committee is unable to properly evaluate the situation of such groups in the State party (art. 1).

    In accordance with paragraphs 10 to 12 of its revised treaty-specific reporting guidelines (CERD/C/2007/1) and taking into account its general recommendation No. 24 (1999) concerning article 1 of the Convention and the general recommendation No. 30 (2004) on discrimination against non-citizens, the Committee recommends that the State party:

    1. Conduct research into the commonly spoken languages, mother tongues and other indicators of diversity and collect information from social surveys on vulnerable groups, and
    2. Collect comprehensive, reliable and up-to-date statistical data on socioeconomic indicators, disaggregated by nationality and ethnic origin, including on immigrants and refugees, in order to define policies taking into account the specific needs of all segments of its society and to allow the Committee to allow a better assessment of the rights enshrined in the Convention are protected in Japan.
Definition of racial discrimination
  1. The Committee is concerned that the definition of racial discrimination in paragraph 1 of article 14 of the Constitution of Japan, which prescribes the principles of equality and non-discrimination does not include the grounds of national or ethnic origin, colour or descent, and therefore does not fully meet the requirements of article 1 of the Convention. Similarly, there is no adequate definition of racial discrimination in domestic legislation (arts 1 and 2).

    The Committee recommends that the State party adopt in its legislation a comprehensive definition of racial discrimination which integrates the grounds of national or ethnic origin, colour and descent, in full compliance with article 1, paragraph 1, of the Convention.

Absence of a specific and comprehensive law prohibiting racial discrimination
  1. While noting that some laws include provisions against racial discrimination, the Committee is concerned that acts and incidents of racial discrimination continue to occur in the State party and that the State party has not yet enacted a specific and comprehensive law on the prohibition of racial discrimination which will enable victims to seek appropriate legal redress for racial discrimination (art. 2).

    The Committee urges the State party to adopt specific and comprehensive legislation prohibiting racial discrimination, both direct and indirect, in compliance with articles 1 and 2 of the Convention, which will enable victims of racial discrimination to seek appropriate legal redress.

National Human Rights Institution
  1. The Committee is concerned that the State party has not yet established a national human rights institution in full compliance with the Paris principles. In this context, the Committee notes that the examination of the Human Rights Commission Bill was scrapped in 2012 following the dissolution of the House of Representatives and that the progress made to establish a national human rights institution has been very slow. (art. 2).

    Bearing in mind its general recommendation No. 17 (1994) on the establishment of national institutions to facilitate implementation of the Convention, the Committee recommends that the State party promptly resume the consideration of the Human Rights Commission Bill and expedite its adoption with a view to establishing an independent national human rights institution, providing it with adequate human and financial resources as well as with a mandate to address complaints of racial discrimination, in full compliance with the Paris principles (General Assembly resolution 48/134).

Compliance of the legislation with article 4
  1. While noting the position of, and the reasons provided by, the State party with regard to the Committee's recommendation to withdraw or reduce the scope of the State's party reservations on sub-paragraphs (a) and (b) of article 4 of the Convention, the Committee regrets the decision of the State party to maintain its reservations. While noting that the dissemination or expression of racist ideas can constitute defamation and other crimes under the Penal Code, the Committee is concerned that the legislation of the State party does not fully comply with all provisions of article 4 of the Convention.

    The Committee encourages the State party to review its position and again consider withdrawing its reservation to sub-paragraphs (a) and (b) of article 4. Recalling its general recommendations No. 15 (1993) and No. 35 (2013) on combatting racist hate speech, the Committee recommends that the State party take appropriate steps to revise its legislation, in particular its Penal Code, in order to give effect to the provisions of article 4.

Hate speech and Hate crimes
  1. The Committee is concerned about reports of the spread of hate speech including incitement to imminent violence in the State party by right-wing movements or groups which organize racist demonstrations and rallies against foreigners and minorities, in particular Koreans. The Committee is also concerned by reports of statements made by public officials and politicians amounting to hate speech and incitement to hatred. The Committee is further concerned by propagation of hate speech and incitement to racist violence and hatred during rallies and in the media, including the Internet. Furthermore, the Committee is concerned that such acts are not always properly investigated and prosecuted by the State party (art. 4).

    Recalling its general recommendations No. 35 (2013) on combating racist hate speech, the Committee recalls that measures to monitor and combat racist speech should not be used as a pretext to curtail expression of protest. However, the Committee reminds the State party of the importance of safeguarding the rights of vulnerable groups in need of protection against racist hate speech and hate crimes. The Committee recommends, therefore that the State party take appropriate measures to:

    1. Firmly address manifestations of hate and racism as well as incitement to racist violence and hatred during rallies;
    2. Take appropriate steps to combat hate speech in media including the Internet;
    3. Investigate and, where appropriate, prosecute private individuals as well as organizations responsible for such acts ;
    4. Pursue appropriate sanctions against public officials and politicians who disseminate hate speech and incitement to hatred; and
    5. Address the root causes of racist hate speech and strengthen measures of teaching, education, culture and information, with a view to combating prejudices which lead to racial discrimination and to promoting understanding, tolerance and friendship among nations and among racial or ethnic groups.
Migrant workers
  1. The Committee is concerned about reports of unequal treatment of migrants in employment and in access to housing. The Committee is also concerned about reports that the rights of foreign technical interns are violated through non-payment of proper wages, subjection to inordinately long working hours, and other forms of exploitation and abuses. (art. 5).

    The Committee recommends that the State party reinforce its legislation in order to firmly combat racial discrimination against migrants in employment and access to housing and improve migrants employment status, bearing in mind the Committee's general recommendation No. 30 (2004) on discrimination against non-citizens. The Committee also recommends that the State party take appropriate steps to reform the technical intern training program in order to protect the working rights of technical interns.

Access by non-citizens to public service jobs
  1. While noting the explanations provided by the delegation of the State party, the Committee is concerned about restrictions and difficulties faced by non-citizens in accessing some public service jobs which do not require the exercise of the State authority. The Committee is particularly concerned about the position and the continued practice of the State party to exclude competent non-citizens to act as mediators in family dispute settlement courts. (art. 5).

    Recalling its general recommendation No. 30 (2004) on discrimination against non-citizens, the Committee recommends that the State party review its position so as to allow competent non-citizens to act as mediators in family dispute settlement courts. The Committee also recommends that the State party remove the legal and administrative restrictions in order to promote more participation by non-citizens in public life including access to public jobs which do not require the exercise of the State authority, paying due attention to non-citizens who have been living in the State party for a long period of time. The Committee further recommends that the State party provide in its next periodic report comprehensive and disaggregated data on the participation of non-citizens in public life.

Access by non-citizens to the National Pension Scheme
  1. While noting that the National Pension Act covers all peoples residing in Japan irrespective of their nationality, the Committee is concerned that upon the removal of the nationality clause from the National Pension Law in 1982, combined with the age and the residence requirements introduced by the amendment of 1986, a number of non- citizens, including Koreans who lost their Japanese nationality in 1952, may have been left out and remain ineligible for pension benefits under the national pension scheme. The Committee is also concerned that despite the removal in 1982 of the nationality clause from the Basic Disability Pension of the National Pension Law, non-citizens who lost eligibility to receive benefits before January 1, 1982 due to the nationality clause and other non-citizens with disabilities who were over the age of 20 as of the same date, remain excluded from receiving the Basic Disability Pension (art. 5).

    Recalling its general recommendation No. 30 (2004) on discrimination against non-citizens, the Committee recommends that the State party take measures to allow non-citizens, in particular Koreans, who may have been left out and remain excluded from the National Pension Act due to the age requirement, to be eligible for the national pension scheme. The Committee also recommends that the State party amend its legislation in order to allow non-citizens who are currently ineligible to apply for the Basic Disability Pension.

Access by non-citizens to public places and facilities
  1. The Committee is concerned about the continued exclusion of non-citizens on the basis of race or nationality from accessing some public places and facilities of general use, such as restaurants, hotels, family public bathhouses and stores, in violation of articles 2 and 5 of the Convention (art. 2, 5).

    The Committee recommends that the State party take appropriate measures to protect non-citizens from discrimination in access to public places, in particular by ensuring effective application of its legislation. The Committee also recommends that the State party investigate and sanction such acts of discrimination and enhance public awareness-raising campaigns on the requirements of the relevant legislation.

Trafficking in persons
  1. While noting information provided by the delegation of the State party on measures taken to prevent and combat trafficking in persons, the Committee is concerned about the persistence of trafficking in minority women in the State party, in particular for purposes of sexual exploitation. The Committee is also concerned about the lack of data which would enable an assessment of the extent of the phenomenon of trafficking in the State party. The Committee is further concerned about the absence of information on specific legislative provisions against trafficking as well as on cases related to investigations, prosecutions and sanctions imposed on those responsible. (art. 5).

    The Committee recommends that the State party:

    1. Adopt specific legislation against trafficking in persons;
    2. Intensify its efforts to combat trafficking in persons, including of migrant women, and take preventive measures to address its root causes in the context of the Japan's Action Plan to Combat Trafficking in Persons ;
    3. Provide assistance, protection, temporary residence status, rehabilitation and shelters as well as psychological and medical services and other assistance to victims;
    4. Promptly and thoroughly investigate, prosecute and punish those responsible;
    5. Provide specialized training to all law enforcement officials, including police officers, border guards and immigration officers in the identification of, assistance to, and protection of victims of trafficking; and
    6. Inform the Committee of the situation on trafficking in the State party, especially of people from minority groups.
Violence against foreign and minority women
  1. The Committee is concerned about information of persistent violence against foreign, minority and indigenous women. The Committee is particularly concerned that under the provisions of the revised Immigration Control and Refugee Recognition Act of 2012, authorities may revoke the residence status of foreign women who have been married to a Japanese national or a foreigner with a permanent residency status in case such foreign women “fail to continue to engage in activities as spouse while residing in Japan for more than six months”, as provided under Section I, Article 22-4 of the Immigration Control Act. These provisions may prevent foreign women who are victims of domestic violence from their husbands from leaving abusive relationships and from seeking assistance. (art. 2, 5).

    In light with its general recommendation No. 25 (2000) on gender-related dimensions of racial discrimination and No. 30 (2004) on discrimination against non-citizens, the Committee recommends that the State party take adequate measures to effectively address the issue of violence against migrant, minority and indigenous women, by prosecuting and sanctioning all forms of violence against them, as well as to ensure that victims have access to immediate means of redress and protection. It should also review its legislation on residence status to ensure that foreign women married to Japanese citizens or to non-citizens with permanent residence status will not be expelled upon divorce or repudiation, and that the application of the law does not have the effect, in practice, of forcing women to remain in abusive relationships.

Comfort women
  1. The Committee notes information provided by the delegation of the State party about efforts made to solve the issue of foreign “comfort women” who were sexually exploited by the Japanese military during the World War II. The Committee also notes information on compensation provided through the Asian Women Fund established by the State party in 1995 and Government expressions of apology, including the apology of the Japanese Prime Minister in 2001. Bearing in mind that human rights violations against surviving “comfort women” persist as long as their rights to justice and reparation are not fully realized, the Committee is concerned at reports that most of “comfort women” have never received recognition, apologies or any kind of compensation. (art. 2, 5).

    The Committee urges that the State party take immediate action to:

    1. Conclude investigations on violations of the rights of comfort women by the Japanese military, and bring to justice those responsible for human rights violations;
    2. Pursue a comprehensive, impartial and lasting resolution of the issue of comfort women including expressions of sincere apology and the provision of adequate reparation to all surviving comfort women or to their families; and
    3. Condemn any attempts at defamation or denial of such events.
Korean schools
  1. The Committee is concerned about the legislative provisions and government's actions that hinder the right to education of children of Korean origin, including: a) the exclusion of Korean schools from the High School Tuition Support Fund ; b) the suspension or continued decrease of funding allocated by local governments to Korean schools. (art. 2, 5).

    Recalling its general recommendation No. 30 (2004) on discrimination against non-citizens, the Committee reiterates its recommendation included in paragraph 22 of its previous concluding observations that the State party ensure that there is no discrimination in the provision of educational opportunities and that no child residing in its territory faces obstacles to school enrolment. The Committee encourages the State party to revise its position and to allow Korean schools to benefit, as appropriate, from the High School Tuition Support Fund, as well as to invite local governments to resume or maintain the provision of subsidies to Korean schools. The Committee recommends that the State party consider acceding to the UNESCO Convention against Discrimination in Education of 1960.

Situation of Ainu people
  1. While noting efforts by the State party to promote and protect the rights of the Ainu people, the Committee is concerned at shortcomings in measures developed by the State party, including; a) the low/insufficient number of Ainu representatives in the Council of the Ainu Promotion Policy and in other consultative bodies ; b) persistent gaps between Ainu people, including those living outside Hokkaido, and the rest of the population in many areas of life, in particular in education, employment and living conditions; and c) insufficient measures taken to protect the rights of Ainu people to land and natural resources and the slow progress made towards the realization of their right to their own culture and language. (art. 5).

    In light of its general recommendation No. 23 (1997) on the rights of Indigenous peoples and taking into account the United Nations Declaration on the Rights of Indigenous Peoples, the Committee recommends that the State party:

    1. Consider increasing the number of Ainu representatives in the Council of the Ainu Promotion Policy and in other consultative bodies;
    2. Enhance and speed up the implementation of measures taken to reduce the gaps that still exist between the Ainu people and the rest of the population with regard to employment, education and living conditions;
    3. Adopt appropriate measures to protect the rights of Ainu people to land and natural resources, and foster the implementation of measures aimed at the realization of their rights to their culture and language;
    4. Regularly conduct comprehensive surveys on the situation of Ainu people in order to adjust its programmes and policies; and
    5. As already recommended in paragraph 20 of the Committee's previous concluding observations, consider ratifying the International Labour Organization Convention No. 169 (1989) concerning Indigenous and Tribal Peoples in Independent Countries.
Situation of Ryukyu/Okinawa
  1. The Committee regrets the position of the State party not to recognise the Ryukyu/Okinawa as indigenous peoples, despite recognition by UNESCO of their unique ethnicity, history, culture and traditions. While noting measures taken and implemented by the State party concerning Ryukyu based on the Act on Special Measures for the Promotion and Development of Okinawa and Okinawa Promotion Plan, the Committee is concerned that sufficient measures have not been taken to consult Ryukyu representatives regarding the protection of their rights. The Committee is also concerned by information that not enough has been done to promote and protect Ryukyu languages, which are at risk of disappearance, and that education textbooks do not adequately reflect the history and culture of Ryukyu people. (art. 5).

    The Committee recommends that the State party review its position and consider recognising the Ryukyu as indigenous peoples and take concrete steps to protect their rights. The Committee also recommends that the State party enhance its consultations with Ryukyu representatives on matters related to the promotion and protection of their rights. The Committee further recommends that the State party speed up the implementation of measures adopted to protect the Ryukyu language from risk of disappearance, facilitate education of Ryukyu people in their own language and include their history and culture in textbooks used in school curricula.

Situation of Burakumin
  1. The Committee regrets the position of the State party which excludes the Burakumin from the application of the Convention on the grounds of descent. It is concerned that the State party has not yet adopted a uniform definition of Burakumin, as raised by the Committee in its previous concluding observations. The Committee is concerned about the lack of information and indicators to assess the impact of concrete measures implemented by the State party upon the termination of the Dowa Special Measures in 2002, including measures to counter discrimination against the Burakumin. The Committee is also concerned about the persistent socio-economic gaps between the Burakumin and the rest of the population. The Committee is further concerned at reported abuses of the illegal access to the family registration system, which may be used for discriminatory purposes against Burakumin (art. 5).

    Bearing in mind its general recommendation No. 29 (2002) on descent, the Committee recalls that discrimination on the ground of descent is fully covered by the Convention. The Committee recommends that the State revise its position and adopt a clear definition of Burakumin in consultation with Buraku people. The Committee also recommends that the State party provide information and indicators on concrete measures taken upon the termination of the Dowa Special Measures in 2002, in particular on living conditions of Burakumin. The Committee further recommends that the State party effectively apply its legislation to protect Burakumin against illegal access to their family data which may expose them to discriminatory acts, investigate all incidents relating to illegal abuses of the family registration and punish those responsible.

Refugees and asylum seekers
  1. The Committee is concerned about reports of racial discrimination faced by some refugees and asylum seekers, in particular non-Asians and Africans, at work, school and in interactions with public institutions and local communities. The Committee is also concerned about the detention of asylum seekers for long periods of time and inadequate conditions in detention facilities. While noting that the Japanese Nationality Act has a provision for the prevention and the reduction of statelessness, the Committee is concerned that the State party has not yet developed a statelessness determination procedure. It is also concerned that some stateless persons without residence permits have faced indefinite pre-deportation detention and some have been at risk of human rights abuses. (art. 5).

    In light of its general recommendation No. 22 (1996) on refugees and displaced persons and bearing in mind its general recommendation No. 34 (2011) on the discrimination against people of African descent, the Committee recommends that the State party take measures to:

    1. Promote non-discrimination and understanding among its local authorities and communities with regard to refugees and asylum seekers;
    2. Guarantee that detention of asylum seekers is used only as a measure of last resort and for a shortest period of time as possible. The State party should give priority to alternative measures to detention, as provided in its legislation; and
    3. Develop a statelessness determination procedure to adequately ensure the identification and the protection of stateless persons.

    The State party should also consider acceding to the 1954 Convention relating to the Status of Stateless Persons and to the 1961 Convention on the Reduction of Statelessness.

Minority languages and textbooks
  1. While noting information provided by the State party, the Committee regrets that the State party has not taken adequate measures to promote education in and of minority languages for children belonging to minorities or indigenous peoples. The Committee is concerned about the lack of information on steps taken to revise the existing textbooks in order to adequately reflect the history, culture, and contributions of Japanese groups protected by the Convention. (art. 5).

    The Committee recommends that the State party facilitate education in and of minority languages for children belonging to minorities and indigenous peoples, including the Ainu and Ryukyu peoples. The Committee recommends that the State party revise those textbooks that do not reflect the history, culture, and contributions of Japanese groups protected by the Convention.

Ethno-religious profiling of members of Muslim communities
  1. The Committee is concerned about reports of surveillance activities of Muslims of foreign origin, by law enforcement officials of the State party which may amount to ethnic profiling. The Committee considers systematic collection of security information about individuals, solely on the basis of their belonging to an ethnic or ethno-religious group, a serious form of discrimination (art. 2, 5).

    The Committee urges the State party to ensure that its law enforcement officials do not rely on ethnic or ethno-religious profiling of Muslims.

Promotion of tolerance and mutual understanding
  1. While noting efforts by the State party to combat racial prejudices and stereotypes including human rights education and awareness-raising activities based on the concept of mutual understanding, such as the Basic Plan for the Promotion of Human Rights Education and Encouragement of 2002, the Committee is concerned about reports on the increase of xenophobic and discriminatory attitudes against non-citizens and indigenous peoples, including through mass media. (art. 2, 7).

    The Committee recommends that the State party:

    1. Redouble its efforts of public education and awareness-raising campaigns;
    2. Continue to integrate human rights education in school curricula;
    3. Promote racial harmony and tolerance in mass media and train media and journalists on human rights; and
    4. Enhance its activities related to the promotion of mutual understanding and tolerance among different ethnic groups living in its territory.

D. Other recommendations

Ratification of other instruments
  1. Bearing in mind the indivisible nature of all human rights, the Committee encourages the State party to consider ratifying those international human rights instruments to which it is not already a party, especially those that relate directly to racial discrimination, such as the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families and the International Labour Organization Domestic Workers Convention, 2011 (No. 189).

Follow-up to the Durban Declaration and Programme of Action
  1. The Committee requests that the State party include in its next periodic report specific information on action plans and other measures adopted to implement the Durban Declaration and Programme of Action of 2001, as well as the outcome document of the Durban Review Conference, held in Geneva in April 2009 at the national level.

Dialogue with civil society
  1. The Committee recommends that the State party consult and expand its dialogue with civil society organizations working in the area of human rights protection, in particular those combating racial discrimination, when preparing its next periodic report.

Amendment to article 8 of the Convention
  1. The Committee recommends that the State party ratify the amendment to article 8, paragraph 6, of the Convention, adopted on 15 January 1992 at the fourteenth Meeting of States Parties to the Convention and endorsed by the General Assembly in its resolution 47/111 of 16 December 1992.

Declaration under article 14
  1. The Committee encourages the State party to make the optional declaration provided for under article 14 of the Convention recognizing the competence of the Committee to receive and consider individual complaints.

Follow-up to concluding observations
  1. In accordance with article 9, paragraph 1, of the Convention and rule 65 of its amended rules of procedure, the Committee requests the State party to provide information, within one year of the adoption of these concluding observations, on its follow-up to the recommendations contained in paragraphs 17, 18 and 22 above.

Recommendations of particular importance
  1. The Committee also wishes to draw the attention of the State party to the particular importance of the recommendations contained in paragraphs 11, 19, 21 and 23 above, and requests the State party to provide detailed information in its next periodic report on the specific measures taken to implement them.

Dissemination
  1. The Committee recommends that the State party's periodic reports be made readily available to the general public as soon as they are submitted and that the Committee's concluding observations with respect to these reports be similarly publicized in the official and other commonly used languages, as appropriate.

Preparation of the next report
  1. The Committee recommends that the State party submit its tenth to eleventh periodic reports in a single document by 14 January 2017, taking into account the treaty-specific reporting guidelines adopted by the Committee at its seventy-first session (CERD/C/2007/1) and addressing all the points raised in these concluding observations. The Committee also urges the State party to observe the page limit of 40 pages for treaty-specific reports and 60.80 pages for the common core document (see the harmonized reporting guidelines in HRI/GEN/2/Rev.6, chapter I, paragraph 19).

韓国版『王様の耳はロバの耳』

驢馬の耳

むかし新羅の國に景文王といふ王さまがいらつしやいました。大そう耳が長くて、兎の耳どころではない、まるで驢馬の耳のやうでした。

王さまはそれを人に見られるのが耻(はづ)かしいので、一人の職人に云ひつけて、頭巾をおこしらへさせになりました。そして晝も夜も、起きてゐるときも、寝てゐるときも、始終その頭巾を被っていらつしやいました。だから王さまの耳が驢馬の耳のやうであるといふことは、誰も知りませんでした。

いいえ、たつた一人知つてゐるものがゐました。それは頭巾をこしらへた職人です。しかし王さまは、
『もしわしの耳が長いといふことを、他人に話したら、お前の命はないぞ。』
と、職人におつしやいましたから、職人は死ぬまで誰にも話しませんでした。

職人はあるとき重い病氣にかかりました。今度はとてもよくならないと思ふと、お腹の中にむづむづしてゐたことを吐き出して死にたいと思ひました。そこで職人は道林寺といふお寺の竹藪に入つて、あたりに人がゐないのを見届けたあとで、せい一杯大きな聲で、
『王さまの耳は驢馬の耳。』
と怒鳴つて死にました。

するとそれからといふものは、風がふいて竹が動くたびに、
『王さまの耳は驢馬の耳。』
という聲がしました。王さまは大そう驚いて、すぐに竹藪を伐(き)つておしまひになつて、そのあとに山茱萸(さんしゆゆ)といふ木をお植ゑさせになりました。すると今度は山茱萸が風の吹くたびに、
『王さまの耳は驢馬の耳。』
といふ聲を出しました。王さまはもうあきれてしまつて、その儘にしておおきになりました。

河野談話はいわゆる「強制連行」の実在を認めていない

結論として、河野談話はいわゆる「強制連行」があったことを認めていない、と考えるべきである。一部の論者には、河野談話がいわゆる「強制連行」があったことを認めたとする主張があるが、大きな誤りと言わなければならない。

慰安婦関係調査結果発表に関する河野内閣官房長官談話

いわゆる従軍慰安婦問題については、政府は、一昨年12月より、調査を進めて来たが、今般その結果がまとまったので発表することとした。

今次調査の結果、長期に、かつ広範な地域にわたって慰安所が設置され、数多くの慰安婦が存在したことが認められた。慰安所は、当時の軍当局の要請により設営されたものであり、慰安所の設置、管理及び慰安婦の移送については、旧日本軍が直接あるいは間接にこれに関与した。慰安婦の募集については、軍の要請を受けた業者が主としてこれに当たったが、その場合も、甘言、強圧による等、本人たちの意思に反して集められた事例が数多くあり、更に、官憲等が直接これに加担したこともあったことが明らかになった。また、慰安所における生活は、強制的な状況の下での痛ましいものであった。

なお、戦地に移送された慰安婦の出身地については、日本を別とすれば、朝鮮半島が大きな比重を占めていたが、当時の朝鮮半島は我が国の統治下にあり、その募集、移送、管理等も、甘言、強圧による等、総じて本人たちの意思に反して行われた。

いずれにしても、本件は、当時の軍の関与の下に、多数の女性の名誉と尊厳を深く傷つけた問題である。政府は、この機会に、改めて、その出身地のいかんを問わず、いわゆる従軍慰安婦として数多の苦痛を経験され、心身にわたり癒しがたい傷を負われたすべての方々に対し心からお詫びと反省の気持ちを申し上げる。また、そのような気持ちを我が国としてどのように表すかということについては、有識者のご意見なども徴しつつ、今後とも真剣に検討すべきものと考える。

われわれはこのような歴史の真実を回避することなく、むしろこれを歴史の教訓として直視していきたい。われわれは、歴史研究、歴史教育を通じて、このような問題を永く記憶にとどめ、同じ過ちを決して繰り返さないという固い決意を改めて表明する。

なお、本問題については、本邦において訴訟が提起されており、また、国際的にも関心が寄せられており、政府としても、今後とも、民間の研究を含め、十分に関心を払って参りたい。

河野談話はいわゆる「強制連行」を認めているか

とくに関心が高いように思われる、日本軍による「強制連行」があったかどうかの問題について、以下に私見を示しておく。

慰安所は、当時の軍当局の要請により設営されたものであり、慰安所の設置、管理及び慰安婦の移送については、旧日本軍が直接あるいは間接にこれに関与した。

このくだりは、慰安所の設置、管理および慰安婦の移送について述べたものであり、ここから募集にあたり「強制連行」があったかどうかを明らかにすることはできない。

慰安婦の募集については、軍の要請を受けた業者が主としてこれに当たったが、その場合も、甘言、強圧による等、本人たちの意思に反して集められた事例が数多くあり、更に、官憲等が直接これに加担したこともあったことが明らかになった。

慰安婦の募集にあたり、官憲等が直接これに加担したこともあったと述べているが、その方法としては、本人たちの意思に反して集められた事例が数多くあるとする一方、具体的には「甘言、強圧による等」とするにとどまり、いわゆる「強制連行」が含まれるかどうかは読者の解釈に委ねられている。「等」の文字にそれを含むと見ることもできるが、これをもって河野談話が「強制連行」を認めたと解するのは困難であるように思われる。

安倍晋三内閣総理大臣は、2007年の答弁書において「同日の調査結果の発表までに政府が発見した資料の中には、軍や官憲によるいわゆる強制連行を直接示すような記述も見当たらなかった」としており、河野談話にいう「甘言、強圧による等」には、いわゆる「強制連行」を含まない、と考えるのが妥当である。

また、慰安所における生活は、強制的な状況の下での痛ましいものであった。

「強制」の文字が見える、唯一の箇所である。これは慰安所の生活を述べたものであり、募集にあたり「強制連行」があったことを示すものではない。

当時の朝鮮半島は我が国の統治下にあり、その募集、移送、管理等も、甘言、強圧による等、総じて本人たちの意思に反して行われた。

慰安婦の募集等において本人たちの意思に反して行われたことを述べた箇所であるが、ここでも「強制連行」の有無を読みとらせるものはなく、また官憲の関与についても直接的には触れていない。

河野談話の見解は信用できるのか

官憲が慰安婦を募集するにあたり、いわゆる強制連行があったかどうかについて、河野談話および安倍答弁書の述べるところは信用できるのか。

できない。

河野談話を発表するにあたり、政府は数多く関係資料の調査及び関係者からの聞き取りを行っているが、その資料の中にはバタビア軍法会議に関する記録も含まれている。このバタビア軍法会議の判決事実の概要には、「一九四四年二月末ころから同年四月までの間、部下の軍人や民間人が上記女性らに対し、売春をさせる目的で上記慰安所に連行し、宿泊させ、脅すなどして売春を強要するなどしたような戦争犯罪行為を知り又は知り得たにもかかわらずこれを黙認した」などの記述があり、ここに記述される事実内容は、疑いの余地もなく、官憲による「強制連行」にほかならない。

このことについては、2013年に共産党の赤嶺政賢議員が質問主意書を挙げており、これに対する麻生太郎内閣総理大臣臨時代理の答弁は、2007年の安倍答弁書と同じ、つまり先に引用したように「同日の調査結果の発表までに政府が発見した資料の中には、軍や官憲によるいわゆる強制連行を直接示すような記述も見当たらなかったところである」というもので、これがいわゆる「強制連行」に当たるものではないとの反論をなしえていない。さりとて「強制連行」があったことを認め、河野談話を歴史的事実にもとづく方向で修正したくもないので、要するに“見落としていた”ということにしているのである。

写真の左側には新築物件があり、そこの水道工事?のために道路を掘りかえしたようですが、おそらく施工業者の方が「れ」のテンプレートをお持ちでなかったのだと思います。あっ、路側帯の白線とおなじ太さみたいですね。

Android用の物理ボタンiKeyを使ってみた(Pressyもどき)

GIGAZINEでこういうガジェットが紹介されていて、面白そうだったのでAmazonで購入してみた。販売店が香港の電脳中心買物隊というところで、7月19日に注文して26日に届いた。

iKeyのパッケージにQRコードが印刷されており、これを開くと製造元サイトにあるアプリのapkファイルをダウンロードできる。が、7月6日にGoogle Playで公開されたので、こちらを使う。バージョンは1.0だが、起動して設定画面を開くとすぐにアップデートを促される。

まず、プレート間地震ですけれども、1930年代の塩屋崎沖地震を考慮されているんですが、御存じだと思いますが、ここは貞観の津波というか貞観の地震というものがあって、西暦869年でしたか、少なくとも津波に関しては、塩屋崎沖地震とは全く比べ物にならない非常にでかいものが来ているということはもうわかっていて、その調査結果も出ていると思うんですが、それに全く触れられていないところはどうしてなのかということをお聴きしたいんです。

貞観の地震について、まず地震動の観点から申しますと、まず、被害がそれほど見当たらないということが1点あると思います。あと、規模としては、今回、同時活動を考慮した場合の塩屋崎沖地震でマグニチュード7.9相当ということになるわけですけれども、地震動評価上は、こういったことで検討するということで問題ないかと考えてございます。

被害がないというのは、どういう根拠に基づいているのでしょうか。少なくともその記述が、信頼できる記述というのは日本三大実録だけだと思うんですよ。それには城が壊れたという記述があるんですよね。だから、そんなに被害が少なかったという判断をする材料はないのではないかと思うんですが。

済みません、ちょっと言葉が断定的過ぎたかもしれません。御案内のように、歴史地震ということもありますので、今後こういったことがどうであるかということについては、研究的には課題としてとらえるべきだと思っていますが、耐震設計上考慮する地震ということで、福島地点の地震動を考える際には、塩屋崎沖地震で代表できると考えたということでございます。

どうしてそうなるのかはよくわからないんですけれども、少なくとも津波堆積物は常磐海岸にも来ているんですよね。かなり入っているというのは、もう既に産総研の調査でも、それから、今日は来ておられませんけれども、東北大の調査でもわかっている。ですから、震源域としては、仙台の方だけではなくて、南までかなり来ているということを想定する必要はあるだろう、そういう情報はあると思うんですよね。そのことについて全く触れられていないのは、どうも私は納得できないんです。

事務局の方から答えさせていただきます。
産総研の佐竹さんの知見等が出ておりますので、当然、津波に関しては、距離があったとしても影響が大きいと。もう少し北側だと思いますけれども。地震動評価上の影響につきましては、スペクトル評価式等によりまして、距離を現状の知見で設定したところでどこら辺かということで設定しなければいけないのですけれども、今ある知見で設定してどうかということで、敷地への影響については、事務局の方で確認させていただきたいと考えております。
多分、距離的には、規模も含めた上でいくと、たしか影響はこちらの方が大きかったと私は思っていますので、そこら辺はちょっと事務局の方で確認させていただきたいと思います。
あと、津波の件については、中間報告では、今提出されておりませんので評価しておりませんけれども、当然、そういった産総研の知見とか東北大学の知見がある、津波堆積物とかそういうことがありますので、津波については、貞観の地震についても踏まえた検討を当然して本報告に出してくると考えております。

先ほどの繰り返しになりますけれども、海溝型地震で、塩屋崎のマグニチュード7.36程度で、これで妥当だと判断すると断言してしまうのは、やはりまだ早いのではないか。少なくとも貞観の佐竹さんのモデルはマグニチュード8.5前後だったと思うんですね。想定波源域は少し海側というか遠かったかもしれませんが、やはりそれを無視することはできないだろうと。そのことに関して何か記述は必要だろうと思います。

先ほど杉山先生から御指摘いただきました1点目につきまして、事務局から説明させていただきますと、中間報告提出時点におきまして、双葉断層ですけれども、東京電力は47.5kmで暫定評価としておりまして、それで地震動評価を実施した結果を報告してきました。途中で37kmに切り替えたのですけれども、それは地質調査の追加調査結果を踏まえた双葉断層の評価として短くしたということであって、地震動評価結果につきましては、37kmの補正は実は行われていなかったんですね。そういうこともありまして、当初報告がなされた暫定評価の47.5kmで審議を進めてきたので、それでまとめたと。
結局、双葉断層の37kmの評価をAサブグループで最終的な評価として妥当なものと認めたのが最後の回でしたので、地震動評価につきましては37kmの評価は実施されていない状況で、基本モデルだけは実施していただいたんですけれども、不確かさモデルについては実施していないということで、これを実はこの評価書の中にも少し書いてございますが、東京電力では、本報告までに37kmの評価を実施することにしておりました。したがいまして、47.5kmというのは、あくまでも中間報告提出時の評価、暫定的なものに対して評価を保安院の方でしたということでありまして、最終的な確定した双葉断層の長さとは少し違いが出てきておりますので、もう少し地質調査と地震動評価のところで明示的にわかるような形、一応書いてはいるんですが、もう少しわかるような形に修正させていただきたいと思います。

ただいまの御説明に御質問等ございましたらお願いいたします。岡村先生。
○岡村委員
貞観ですけれども、確かに地震動をどういうふうに推定するかというのは難しいとは思うんですが、ここでは佐竹ほか(2008)の断層モデルをそのまま、そこから地震動を計算されているんですが、そもそもこういう地震って何なんだということを今の知見で考えると、やはり連動型地震と言われているものだろうと考えるのが妥当だと思うんですね。それは、17世紀ですか、千島海溝で起こったとか、2004年のスマトラ沖地震がそういうものに相当すると考えているわけですけれども、そういう地震というものは、要するにもう少し短い間隔で普通に起こっている震源域が、複数の震源域が同時に破壊する、そういうことで起こるのだろうと言われているわけですね。
そういうふうに考えると、やはりここは、塩屋崎沖地震というものが1つある。もう少し北に行くと宮城県沖地震というものもある。そこをまたぐようなところでこの貞観の地震というものは考えざるを得ない。津波の情報だけではですね。そうすると、やはり今わかっている震源域のところは連動の範囲に含まれるのではないかと考えるのが、今の知識では妥当かなと私は思うんですよね。だから、これだとちょっと外れますよね。塩屋崎沖地震よりちょっと遠いところに貞観の震源モデルを考えて、それとは別のものだというイメージで今、話をされているんですけれども、別にしていいとはなかなか考えにくいのではないかと私は思います。

御指摘ありがとうございました。それぞれの地震をどのように同時活動させるかということは、なかなか難しいところだと我々思っているところですが、まずここで申し上げたいのは、塩屋崎沖自体が、それぞればらばらだったものを、同時活動を見るということを今回やっているということ、それから、貞観の地震も、波源モデルということもありますので、本来、もう少しばらばらしていたのかもしれないということはあるかと思いますが、仮にこういったものを考えた場合、目いっぱい見たとしてもということで今回ちょっと見てみたということです。
御指摘のように、例えば今回の貞観の地震と塩屋崎沖をつなげるかどうかということについては、ちょっと我々もそこまでできるかどうかというところがまだ十分な情報がないのかなと思いますが、そうは申しましても、今回ごらんいただきましたように、まず、こういったそれぞれの地震を考えても、Ssのレベルから考えますと、まだ余裕があるということを踏まえてこのようにさせていただいていると考えています。
ただ、まとめの中でも申し上げましたように、貞観の地震についてはまだ情報を収集する必要があると認識しておりますので、引き続き検討は進めてまいりたいと思ってございます。

○岡村委員
最初の中間報告の案で、また貞観の話ですけれども、どちらも23ページに貞観のことが書いてあって、ここでは、新たな知見の波源モデルを震源断層と仮定した上で地震動を計算したと。それで、小さいということしか書かれていないんですね。
先ほど私が申し上げたのは、それでは足りないのではないですかということを申し上げたつもりで、要するに塩屋崎沖地震、それも連動させているということですけれども、貞観はそれ全体を含むものである可能性があるということなので、それで十分とは思っていないというつもりで言ったんです。それは、東京電力さんも、それでまた検討するとお答えになったと私は理解したので、そのことを少し何か検討していただきたいと思います。
○名倉安全審査官
済みません、逆にお聴きしたいのは、これは、今さまざまな研究機関において、こういった知見をいろいろと、調査結果が今どんどん得られているような状況でありまして、今後、いろいろな知見が得られていく中で、その時々に応じた対応をすべきということであるのか、それとも、今の中間報告における検討の中でそれをやるべきとおっしゃられているのか、そこのところはどちらということで理解すればよろしいでしょうか。
○岡村委員
この中間報告の性格をどう考えるかだと思うんですね。ただ、現状でわかっていることは、先ほど申し上げたことなわけですね。そこからどういう地震動が考えられるかということは、まだ研究としては全く行われていない話ではありますけれども、ただ、そういう海溝型地震に関する知見というものを考えると、それなりのものを考えるべきではないかというのが私の意見です。だから、それをここに入れていただけるのかどうかということだと思います。
だから、地震動に関しては、よくわかっていないということもありますから、今後検討するということでもいいのかもしれないですけれども、ただ、実際問題として、この貞観の時期の地震動を幾ら研究したって、私は、これ以上精度よく推定する方法はほとんどないと思うんですね。残っているのは津波堆積物ですから、津波の波源域をある程度拘束する情報はもう少し精度が上がるかもしれないですが、どのぐらいの地震動だったかというのは、古文書か何かが出てこないと推定しようがないとは思うんですね。そういう意味では、先延ばしにしても余り進歩はないのかとは思うんですが。
○名倉安全審査官
今回、先ほど東京電力から紹介した資料にもありましたけれども、佐竹ほか(2008)の中で、当然、今後の津波堆積物の評価、それは三陸の方もありましたが、それから、多分、南の方も今後やられる必要があると思いますが、そういったものによって、位置的なものにつきましては大分動く可能性があるということもありますので、そこら辺の関係を議論するためのデータとして、今後得られる部分がいろいろありますので、そういった意味では、今、知見として調査している部分も含めた形でやられた方が信頼性としては上がると私は思っていますので、そういう意味では、その時々に応じた知見ということで、今後、適切な対応がなされることが必要だと思います。その旨、評価書の方に記載させていただきたいと思います。

高島先生。
○高島委員
今の問題なんですけれども、例えば南海トラフなどでは、例えば宝永地震のときには、東海、東南海、南海が大体一緒に動いていたと。常にその様に震源域が壊れているわけではないわけですね。それで連動とおっしゃっていると思うんですけれども、そのときの地震動はどうなるか。浜岡については3つと2つと1つとそれぞれ計算していますよね。そういう御趣旨の指摘かと思ったんですけれども、佐竹先生ほかが書いているこのペーパーを知見と呼ぶのはどうかという気がします。文献や論文の類だと思うんです。知見というのはもう少し広く、属性的に明らかになったときに呼ぶのかなという気がしたんですが、表記上どうなんでしょうか。
○纐纈主査
ただ、連動させてしまうと、多分、佐竹ほかの結果によれば、津波の結果に合わなくなってしまうんですよね。
○岡村委員
このモデルは、津波堆積物の分布域まで津波が浸水するというか、それを説明するためのモデルなんですよ。要するに、どこにおいても滑り量とかいろいろファクターを変えていけば、ある程度のものはできるわけですよね。ですから、福島沖を含むようなモデルで、例えばもう少し幅を狭くするとか、沖側の部分をもう少し狭くするとかというような形で延ばせば、多分、津波の浸水域を合わせることはできると思うんですよね。このモデルをつくるときにはいろいろなファクターがありますから。
○纐纈主査
多分おっしゃるとおりだと思いますが、それだと、常識的なスケーリングとかなり離れてしまうので、地震動のモデルとしてはあり得ないものになってしまうのではないかと思いますけれども。
○岡村委員
それは、そこまで断言できるほど解析されているのかわからないですが、どうしてそういうふうに思われるわけでしょうか。
○纐纈主査
断層面サイズが大きくなれば、滑り量もそれに比例して当然大きくなりますから。
○岡村委員
いやそれほど、このモデルも、例えば大体同じ範囲で、5m、7m、10mといういろいろな計算をしているわけですよね。そのぐらいの差でかなり変わってくるということですから、私は、一応、モデルはみんな議論しましたけれども、少しずらして震源域を含むような形にすること自体はできるのではないかと思います。それは、やってみないとわからないですが。
○纐纈主査
御本人がそうおっしゃっているのでは、そのとおりかもしれません。
○名倉安全審査官
事務局からよろしいですか。 今回の中間報告におきましては、東京電力の方は津波の評価をまだ提出しておりません。そういうこともありまして、本報告で津波のところもやってくるはずですし、その中で、こういった知見も踏まえた場合の評価といったものが一体どういうふうにできるのか。その場合に、東京電力が設定した津波の解析条件ではありますけれども、そういったものに対して、津波堆積物のところ、要は得られているところの結果、そこら辺、ちょっと検討できるかどうかということはありますが、少しそういったもの、津波の波源を設定するときの考え方等との整合性もとった上で、地震動評価上何か影響があるのかという位置付けの検討は、少し必要なのかなと思っております。
○纐纈主査
何らかの記述をいただくということで御納得いただいたということでよろしいでしょうか。

あともう一点、またしつこいようですけれども、貞観ですが、貞観をどう扱うかというのは、やはりここも先ほどの福島と同じような問題があると思いますので、そこに全く触れないというのはちょっとどうかと思うんですけれども。
○東北電力(広谷)
貞観の地震につきましては、一応、中間報告書の方にも、この地震が海洋プレート内地震か、もしくはプレート間地震であった場合、敷地に与える影響という形で、簡単な記載はしてございます。ただ、やはり先ほどの佐竹ほかに対しまして直接的な記載は特にしておりません。
先ほど、東京電力さんの方から説明がありましたけれども、仮に佐竹ほかモデルに対しましてモデル8とかモデル10というものがありましたが、等価震源距離的に見ますと、この2つの断層についてはやはり女川と福島とほぼ同じようなところに位置しておりますので、今後、福島で検討されるようなことにつきましては、女川についても同じように鋭意検討していく必要があると考えてございます。

NHKニュースの『美味しんぼ』報道が、大阪大学・平川秀幸教授のコメントを訂正した

NHKニュースは『美味しんぼ』問題について5月12日、大阪大学の平川秀幸教授のコメントを載せていましたが、当初の報道では平川教授のかねてからの見解を反映したとは思えないものでした。

「美味しんぼ」の問題を巡っては、地元、福島県などからの批判は当然だという受け止めと同時に、影響が波及して不安を抱える人たちがそれを口にできなくなるようなことになれば、大きな問題だと懸念する声も出ています。

科学技術と社会の関係を専門に研究している、大阪大学コミュニケーションデザイン・センターの平川秀幸教授は「今回の『美味しんぼ』の内容は科学的に一面的で、福島県など当事者の批判を招いたのは当然と言える。その一方で、原発事故の直後に鼻血などの症状を訴える人がいたことについて、なぜそういうことが起きたか、どれくらい起きていたかなど十分な調査はされていない。そうしたなかで今回のように『不安』を取り上げたことと、それを否定する反応が起きたことで、表に出せない不安を抱えた人たちが、それを口にすることすら抑圧されることになると大きな問題だ。同じ放射線量でも不安の感じ方は人それぞれで、行政は一人一人の不安に対応していく必要があり、不安を口にできなければそれもできなくなる。今回の問題は、放射線に関する知識の問題というよりも、原発事故後に生じた国などへの不信感が3年たった今もぬぐえず、出している情報が正しくても受け入れられない状況があることの表れと考えられ、被ばくと鼻血の因果関係の問題としてだけ捉えると、見方を誤るのではないか」と話しています。

翌13日、平川教授のコメントが修正されました。こちらのほうが平川教授の本来の意図に近いものと思われます。相違点を強調します。

「被ばくと鼻血の因果関係…」は場所が入れかわっただけですが、全体的にみて、初期報道では原発事故と鼻血との関連を強調したうえで否定する方向にかたむき(本来のコメントでは原発事故に限定していないのに、初期報道は「原発事故」に限定している点にも注意)、『美味しんぼ』の表現が科学的に「一面的」であり批判を招いたのは「当然」だと断じていて、コメント後半の「住民が不安を口にできなければ行政は対応できない」との趣旨に矛盾する傾向があります。また、福島などの「反発」が、初期報道では「当事者の批判」となっていて、批判の正当性がより強調されていました。

祥伝社『英国人記者が見た連合国戦勝史観の虚妄』について、著者のヘンリー・ストークス氏がみずからの発言を捏造されたと述べたと共同通信が報じた問題で、ストークス氏から聞き取りを行っていたジャーナリストのアンジェラ・エリカ・クボ氏が、この問題にからみ辞職した際に著者ストークス氏と翻訳者の藤田裕行氏に送った手紙を公開している。

On May 8th, Kyodo News published an article concerning former New York Times Tokyo bureau chief Henry S. Stokes and his recent best-seller 英国人記者が見た連合国戦勝史観の虚妄 (Falsehoods of the Allied Nations’ Victorious View of History, as Seen by a British Journalist). The Kyodo News article raised questions about the veracity of the book and whether it really represented Mr. Stokes’s views or the views of the two right wing individuals, Hiroyuki Fujita, who helped “translate” the book and Hideaki Kase aka Tony Kase.

共同通信は5月8日、元ニューヨークタイムズ東京支局長ヘンリー・S・ストークス氏と、同氏の最近のベストセラー『英国人記者が見た連合国戦勝史観の虚妄』についての記事を発表しました。共同通信の記事は、書籍の真実性と、それが本当にストークス氏の見解を表したものか、あるいは2人の右翼的な人物である藤田裕行氏(彼が書籍の“翻訳”を支援した)や加瀬英明氏(別名・トニー加瀬)の見解であるかどうかについて、疑問を提起しました。

I am a journalist who is just starting her career and I was asked to do the transcripts for an English version of the book. After some time, I realized that I felt that Mr. Stokes, who is a very nice elderly journalist who I respect, was having his words taken out of context. I resigned from the job and relinquished any further payments. Here are the resignation letters I sent to Mr. Fujita and my notice and apology to Mr. Stokes.

  2. 「(南京)虐殺否定を無断加筆 ベストセラー翻訳者」との見出しも、事実ではありません。
  3. 著者と翻訳者の藤田裕行氏との間で、本の内容をめぐって意思の疎通を欠いていたとの報道がありますが、事実と著しく異なります。

The Note from the Author

  1. Various reports based on Kyodo News are wrong and they do not reflect the author's opinion.
  2. The cross-head of Kyodo News which says "Best-seller translator added lines to deny Nanking Massacre without author's consultation" is not true.
  3. The report which says the author and the translator, Hiroyuki Fujita, lacked communication regarding book contents is wrong and far from the truth.
  4. It was reported by Kyodo News that the last 2 lines of the Japanese translation of Chapter 5 regarding what happened in Nanking on December 1937 did not reflect the author's view. The Kyodo News made a big deal out of it.
    The author's opinion is: The so-called "Nanking Massacre" never took place. The word "Massacre" is not right to indicate what happened. It was orginally a propaganda tool of the KMT government.
  5. The above statements are all based on my opinion.
    The publisher, Shodensha, and the author agreed that we have no need to make any corrections for the 2 lines in question at this stage.

南京虐殺加筆報道を著者「否定」 記事正確と共同通信

 米ニューヨーク・タイムズ紙元東京支局長が、日本軍による「『南京大虐殺』はなかった」と自著で主張した部分は翻訳者による無断加筆だったとして、修正を求めていると伝えた共同通信の報道について、出版元の祥伝社は9日、これを否定する「著者の見解」を発表した。

 著書は「英国人記者が見た連合国戦勝史観の虚妄」(祥伝社新書)。元東京支局長は共同通信の取材に対し「(翻訳者に)後から付け加えられた。修正する必要がある」と明言していたが、「著者の見解」では「記事は著者の意見を反映しておらず誤り」と指摘している。

 共同通信社総務局は「翻訳者同席の上で元東京支局長に取材した結果を記事化したものです。録音もとっており、記事の正確さには自信を持っています」としている。(共同)

弁護士の小倉秀夫さんが「法に触れてもやるのが新しい弁護士の姿」とツイートしてる件が、ときどき取りあげられるんですけど…。ああ、これの件ね。

なるほど。これを見ると、小倉さんが「依頼者のためなら法をも犯してみせるぞ」と言っているように見える。

だいぶ印象が違ってるような気がするね。

いわゆる司法改革によって弁護士になる人が増えると、弁護士間での競争が激しくなり、案件欲しさのあまり触法行為に走る「新しい弁護士」が出現するだろう(だからサービス業化には反対だ)、という警告のようにオレには見えるんですよ。

MIMPIというアクションパズルゲームが面白かったので、滑車の攻略方法を貼りつけておくよ

MIMPIというアクションパズルゲームが面白かった。MIMPI(ミンピ)というのは、このゲームの主人公になる白い犬の名前で(インドネシア語で「夢」という意味なんだそうな)、飼い主を探して夢の世界を冒険する…というストーリー。ミンピのいろんなしぐさがいかにも子犬っぽくて超かわいい。


開発元のオフィシャル予告動画。

ちょっと手こずったのは、滑車にロープを巻きつける箇所で、あとでプレイしたときに自分で見るので画面を貼りつけておくよ。おまけでスイッチも…と思ったけど、プレイするたび正解が変わるっぽいです。

【ガセ】美男美女カップルと似ていない子どもたちの写真【捏造】

疑わしい写真

このようなツイートと写真を見かけました。

美男美女とその2人の子どもと思われる3人、合わせて5人が写っている家族写真ですが、子どもがみな同じ顔をしていて両親のどちらにも似ていません。このツイートが告げるように、両親が整形しているのでしょうか。また、ツイートの主は、これを韓国人の家族だと言っているようです。

本当でしょうか?

もう1つのストーリー

この写真は、海外では別のストーリーとともに語られているようです。概要は以下のようなものです。

中国人の男性 Jian Feng は、生まれた子どもの容貌が悪かったため、妻の浮気を疑って裁判所に告発した。その結果、妻が美容整形をしていたことを告白し、男性は離婚と賠償金を勝ちとった。

冒頭の写真は、この夫婦の写真だというのです。

本当でしょうか?

海外では2013年11月、この離婚裁判のストーリーに冒頭の写真をつけて、おかしなニュースとして盛大に報道されました。たとえば、米国シカゴの放送局WGNのテレビ番組などです。これは日本のテレビ局でも取りあげられています。

離婚ストーリーと写真は無関係

こうした離婚ストーリーが報道された直後、すぐに疑いを持った人たちがいて、この写真はニセものであると主張しています(Huffington Post41 Action News)。

というのも、離婚ストーリーでは、最初の娘が生まれた直後に離婚裁判が始まったことになっているのに、この写真ではさらに2人の子どもが生まれていることと、しかも仲のよさそうな家族写真を撮っていて、離婚裁判をしているようには見えないからです。

かれらによると、離婚ストーリーは2004年に報じられたもので、写真は美容外科クリニックの広告であるとしています。

2004年の離婚ストーリーは、チャイナデイリー紙(中国日報)の香港版が伝えたとしていますが、オレはその元となった記事を見つけることができませんでした。上記の批判者も同様に、ウソのニュースではないかと疑っているようです。

また、写真のほうは台湾の美容外科クリニックの広告として、すでに前年の2012年5月、RocketNews24(日本語版英語版)が紹介しています。

RocketNews24によれば、この写真は、中国の掲示板サイト猫撲貼貼論壇で取りあげられたものです。元の写真を見ると、「あなたが心配しなければならないことはたった一つ、子どもたちにどうやって説明するかだけです」というコピーと、美容外科クリニックの名前と思われる「簡單美」というロゴが入っています(猫撲貼貼論壇では香港のものとしていますが、正しくは台湾のクリニックです)。

この広告は、2つの意味に解釈できます。1つは、このクリニックは非常に技術力があるので、よけいな心配をしなくてよい、という商業的なメッセージ。もう1つは、美容整形をすることで、子どもたちとの信頼関係が崩れてしまうのではないか、という倫理的なメッセージです。

消されたロゴ

冒頭に引用された写真には、ロゴは入っていません。しかし美容外科クリニックの広告写真とされるものには、クリニックや掲示板のロゴが入っています。どちらか一方は、もう一方の写真を元にして作られたものです。どちらが元の写真だったのかお分かりになるでしょうか?

冒頭のロゴ無し写真をもういちど見てみましょう。男性の右ひざから少年のもものあたりにかけて、広告写真でロゴのあった場所が、なんだかぼんやりしているように見えます。とくに男性のスラックスのプリーツ(折り目)が、広告写真ではしっかりしていますが、ロゴ無し写真でははっきりせず、どことなくだらしない印象にさえ見えます。

広告写真からロゴ無し写真を作ることは可能であっても、ロゴ無し写真から広告写真を作るのは不可能だと考えられます。このことから、美容外科クリニックのロゴの入った広告写真を元にして、冒頭のロゴ無し写真が作られたことが明らかです。

ということは、だれかが元の広告写真からロゴやコピーをわざわざ消してしまった、ということになります。一体、どこの、だれが、なんの目的で消しちゃったのでしょうね? あなたはどのように推理しますか?
